insane to me that @patagonia.com is suing incredibly impactful drag queen and climate activist Pattie Gonia for “harming their brand” is Patagonia not a brand for the LGBTQ+ community or for climate activists? because you’ve spent a lot of time pretending to be both.

I don't know the details, but I believe they're suing for $1.00, only because it's some kind of legal requirement to show that they're protecting their brand, rather than out of any actual grievance.

Does it reveal that she is trying to trademark the brand in advance of a collaboration with Patagonia's dorect competitors, thus making the $1 suit look INCREDIBLY more restrained than it probably should be?

They’re not trying to say she can’t use the name. They’re not even looking for that much in damages ($1.00 USD). They just want her to stop appropriating their logo for business purposes. Which, under trademark law, they have to do or they lose it entirely.

Forming an opinion without seeking out the facts in the case is the very reason why the "Lady sues McDonald's over Hot Coffee" is STILL used by people as an example of a frivolous lawsuit. Hopefully, you'll read all the responses to your post, especially the ones from folks like Akiva.

I think they’re legally required to do this. It’s not inherently anti-LGBT. They don’t want *anyone* appropriating their trade dress.

the actual complaint says “defendants applied for a trademark claiming the exclusive right to the brand PATTIE GONIA for, among other things, apparel…” If they didn’t sue for the whopping $1 they are claiming they’d lose their trademark completely.

They sued her for $1.00 after years of trying to get her to stop using their trademark for competing merchandise. They have to defend the trademark or they will lose it. Did you even bother to read the lawsuit or did you just get rage baited into this post?

when Pattie Gonia came to Minneapolis they actually reached out to the org I work for. they wanted us at their event to bring hundreds of new young people into the climate movement if that kind of stuff “harms your brand” I am happy to add your company to my boycott list

you would be lucky to even get to partner with Pattie Gonia. imagine a world where that’s where you put your dollars, instead of trying to bring down a queer creator and climate activist.

Patagonia TRIED coordinating with Pattie to avoid having to go down this route. They told Pattie over and over, don't do this or we'll be forced to sue, please do something else that doesn't infringe and we'll be fine. And Pattie kept saying, nope i'm doing the exact thing you said I can't

They literally cannot do anything but sue here, because Pattie tried to register "Pattie Gonia" as a trademark for apparel. If they don't sue over this, it would effectively end "Patagonia" as a functioning trademark - they would lose the right to sue other infringers. That's the law.

she did the collab with north face and hydroflask in 2023, and thus met with patagonia and the other brands in 2022 to hash it out. that's the only place i could find north face mentioned in the complaint, and she filed for the mark in 2025.

Seriously? If I were North Face's counsel I wouldn't touch this collab with a 30ft pole. Please tell me Pattie filed the mark pro se, b/c any lawyer assisting her needs to have their head examined. I thought Patagonia suing was the right move before learning this. This is just ASKING for a lawsuit.

You can think that's stupid all you want to. I do; copyright doesn't have a similar requirement, and companies should be able to say "we are opting not to enforce" But that's not how trademark law works.

Is this the reason Susan Koman sues so many minor cancer fundraisers for using the phrase "walk for a cure" or the display of a pink ribbon? I alway disagreed with their aggressive enforcement of their trademarks and copyrights. This puts it all in a new light for me.

The theory is that if you're letting anyone use the mark without your permission, it loses its meaning to consumers as a signpost of "this comes from or is authorized by us," and therefore you lose your right to prevent anyone else from using it

also wild that they’re trying to claim exclusive rights to a name that is already the name of an entire region in South America. the fact that they’re explicitly targeting a drag queen in that context certainly does a lot more harm to their brand in my eyes than anything the delightful Pattie has.

They aren't claiming exclusive rights to the name. They're claiming exclusive rights within the realm of apparel, which is what trademark is meant for. This is no different than Hershey Ice Cream not being able to sell candy bar style frozen treats because of Hershey Chocolate.
