How far to fall. DOJ could not answer questions about their own alleged facts or key precedents, but wanted a ruling now, because Trump said so, and a Trump appointed appellate judge questioned whether their DHS declarations met basic thresholds for expert admissibility. Carry on.

I am in Cap Haitien interviewing people deported from the United States. I have been doing this kind of work for almost a decade and it literally does not get more dire than this. People have lost everything they built in the U.S. and are terrified and have no place to go or way to live.

An interesting paper with a significant number of cites I guess I need to read.

Think tanks will soon start releasing non-peer-reviewed modeling of how the permitting bill might affect pollution, if they haven't already. Most will secretly have lots of ideology-driven thumbs on scales. One big way to tip the scales is by ignoring pollution associated with oil and gas exports.

The real question is how this Permitting Reform bill expands global emissions. Most of the fossil infrastructure that will get built without review will be used for methane-gas exports. Advocates’ claim that US emissions will go down is like the three card monte of the campaign for this bill.

I'm talking about *fiscal* debt: the solar we didn't build, the carbon we emitted instead; the rail we didn't build, the wildly inefficient aviation we substituted; the walkable, livable, transit-oriented cities we didn't build, the car-choked disasters we built instead.

I don’t like liking this.

The Senate's permitting bill text is up. It's way too big/complex for anyone who didn't have early access to digest today, so beware hot takes, but this bit (p. 54 line 9) is funny: If an agency misses a deadline, the agency head can't travel >25 miles from their desk til the agency submits the doc.

Can anyone explain to me why a national permitting deal is best negotiated now, mere weeks from an election that is likely to reshape federal power? Let’s stipulate that a deal of some kind is necessary and good; my question is what about the situation makes now more desirable than, say, Q1 2027?

Just went in to get my fries and Diet Coke at In-N-Out Burger while my car charges across the street. The most (southern) California thing about that place is that there is always a 30 car line in the drive thru and zero line at the counter. People are so weird. We need to study this.

Super informative. There are aspects of this that are technical, but some of it is just plain Orwellian. Logging is better for the climate than recycled paper, and, nice trick, leasing a forest eliminates your emissions, not to mention beef has no emissions if it involves deforestation. Wow.

Appreciate the direct link Chris’s post makes between the Supreme Court repeatedly making shit up to suit its agenda, and hack Trump appointees on the lower courts who decide that they are perfectly within their rights to do the same thing

NEW: The Eighth Circuit, Missouri’s maps, and the mess the Roberts Court has brought about. Even as the Supreme Court has tried to stop the Missouri maps chaos, it turns out that a lack of concern for precedent, rules, and stability have trickle-down effects. This evening, at Law Dork:

Senator @heinrich.senate.gov is making a grave mistake negotiating w/Trump & MAGA on “permitting reform.” If a deal is cut, it’ll bulldoze a path for AI data centers & fossil fuels, harming beloved landscapes such as Greater Chaco. And Heinrich will be responsible. I do not say this lightly.

The biggest threats from corporate LLMs are the same threats we’re already organizing against: monopolistic hyper capitalism and environmental destruction. I fully buy @doctorow.pluralistic.net’s criti-hype framing of the rest of it.

15/ The *scale* of the US investment in datacenters is staggering. Other countries are having similar conversations about the effect of AI on economic development, electricity and land etc but hard to compete with US financial sector & technological dominance of AI firms @katemac.bsky.social

I wish well-meaning ~political people~ with big microphones would stop using their platforms to tell Democrats to keep steering away from aggressive climate policy — which they're largely already doing! — and instead, once in a while, remind everyone just how bad the climate crisis is getting.

Staff report about Transit usage and performance at World Cup events in LA/Inglewood. Transit ridership to games was lowest when the US was playing. US fans took Uber/Lyft, clogging up stadium area roads. Shuttle buses stuck in gridlock. So buses were slowest while serving the fewest riders. 😔

Latest example of "You Can Just Do Stuff" governing taken to the extreme. The judge can't physically enforce his or her own ruling, the White House controls law enforcement and Congress won't impeach.

Ambassador Ken Fairfax (ret)@portlandken.bsky.social

1) DHS asks a federal judge for a warrant to hoover up private data from journalists, activists, and trade unions. 2) Judge denies because it is an obvious violation of the 1st and 4th Amendments with no justification. 3) DHS issues its own "Administrative Warrant" and sucks up the data anyway.

Moved from a talk and song at a bat mitzvah today (familiar to many): Solo le pido a Dios Que la guerra no me sea indiferente Es un monstruo grande y pisa fuerte Toda la pobre inocencia de la gente Es un monstruo grande y pisa fuerte Toda la pobre inocencia de la gente

Critique this counterfactual version of abundance? The people eliminated the super majority requirement for bonds, and minority deals were not needed. As a result High Speed Rail was built following I5 at less than half the cost.

We are witnessing a shock redistribution from the many to the rich: The profit share is at its highest level since WWII. The first bump was sellers’ inflation which ushered in Trump. The second bump is Trump’s chaos casino designed to push up profits.
