I’m not sure the Panopticon is still a relevant metaphor. The point there was that a concealed machinery of surveillance could make everyone behave AS IF surveilled, even though the watchers could only observe a few people at once. We seem to have effectively superceded that technical limitation.

Aaron Reichlin-Melnick@reichlinmelnick.bsky.social

The Panopticon was a thought experiment but the technology is now genuinely there to make it a reality and we have to grapple with what that means for us as a society. /yes, I am aware that others countries had this debate and went with total surveillance decades ago.

If the elections go as predicted in a couple weeks, I expect a narrative will form that Republicans lost a lot of seats through terrible campaign decisions like this ad and the Ramaswamy mess. That won't be true, but it might have the side benefit of ending the careers of some really awful people.

Scary Mr. Olmec Man@scarymrolmecman.bsky.social

Genuinely there is a crisis of competence among GOP staffers

This is a much easier problem to fix than federal court forum-shopping. New York law already channels certain lawsuits challenging state policies or regulations into Albany courts. It would be easy to similarly provide that lawsuits challenging NYC rules must be brought in Manhattan courts.

Ben K.@benjaminkabak.com

So we have a little NYC version of the Northern District of Texas and a bunch of plaintiffs who have learned they can venue-shop their anti-Mamdani lawsuits over there. Intolerable for this disgruntled borough of 500K to thwart the will of NYC voters like this. www.crainsnewyork.com/real-estate/...

It's notable that Thomas and Alito, both Bush appointees (though different Bushes), continue to occupy the far right wing of the Supreme Court while all of Trump's nominees, though conservative, are to their left. This pattern doesn't hold true for lower court nominees.

Chris Geidner@chrisgeidner.bsky.social

BREAKING: SCOTUS rejects Trump admin's request to allow it to end gender-affirming medical care in prisons — a significant, if tentative, rejection of one of the admin's most extreme anti-trans arguments. Only Thomas and Alito noted they would have granted the stay. More to come: www.lawdork.com

For Supreme Court vacancies in his first term, Trump basically nominated the same well-credentialed Federalist Society conservatives that another Republican president (say, Jeb Bush) would have picked. In his second term he'll likely pick way more out-there justices if given the chance.

This overdetention happened because NY treats the state prison agency as the only entity capable of calculating felony release dates. That leads to "mistakes" like this, where people are held in city jails past their sentences. But is it really a mistake if the system isn't designed to prevent it?

this is an excellent short piece - maybe the best I've seen on what Trump is doing to relations with allies. Western Europe is not, obviously, a geographic neighbor of the US, but it is stuck plumb in the middle of Trumpist's Near Abroad of the Imagination.

Seva@seva.bsky.social

Russia has a name for neighbors that aren’t supposed to have their own foreign policy: the Near Abroad. It’s a wonderfully dialectical term, each half negating the other to create an imperial synthesis that treats sovereignty as a plaything of the Russian imagination. new post

Fascinating Sotomayor + Gorsuch statement yesterday respecting the denial of cert in a case in which a man was arrested and convicted of being present in the US after illegal reentry, put on supervised release and ordered not to leave the state, then arrested and convicted AGAIN of the same offense.

This massive infusion of money is unlikely to buy control of Congress for the Republicans, but it should be enough to buy the docile loyalty of every Republican officeholder even as Elon descends further into radioactive unpopularity.

An important bit of immigration law which is relevant here; there is already a waiver process — Section 212(k) of the INA — by which immigrants who obtain status through fraud that they didn't know about can avoid consequences like losing a green card. So this is *even weaker* than it already seems.

Democrats are likely to make huge gains across the country next month, which is great. I hope they win control of Congress & a bunch of important state offices. But there are a few solidly blue states where Democratic gains could actually make legislatures worse. Take NY as an example:

Now that Lancman's on Long Island, he's shed his opposition to cash bail & claims he "always supported" pretrial detention. He's spent the campaign complaining about Zohran Mamdani & the Park Slope Food Coop. Hopefully his GOP opponent wins: he'll be conservative, but irrelevant.

Another example: there's 1 GOP-held state senate seat in Brooklyn, which flipped in 2024 & might again. The Democratic candidate is Larry He, a former oil executive who served as adviser to Andrew Cuomo's mayoral campaign until forced to resign by this NYT article. Do we want him in the Dem caucus?

Democrats have large durable majorities in the NY legislature. The Republicans in both chambers basically don't matter. If you're a Democratic legislator, you're part of the majority caucus & have the ear of leadership. A conservative Democratic legislator matters in a way no GOP legislator could.

For example, @rorylancman.bsky.social is a conservative Dem running for an open GOP-held state senate seat on Long Island. He spent his career in Queens, where he was a machine-allied councilmember, & recently carpetbagged out to Great Neck. He'd be a voice against progress in the senate Dem caucus.

My work. Judge Walowski is seeking retention following a wave of reversals by the appellate court. In one case, the court reversed a conviction because Walowski forced a defense attorney to proceed to trial as he recovered from a bout with food poisoning bad enough to call for hospitalization.

Good point! Here’s Rodneyse’s district office. If they go this route, the reform side will need to deliver the summons this week to someone there “of suitable age and discretion,” if such a person can be found.

There's a lot of sorta sanitized 'School House Rock' to Marbury v. Madison, which the legal academy and jurists themselves have adopted One of the myths of Marbury was that it _contemporaneously_ had a wide & noticed impact, when in fact it was buried and overlooked for ~80+ years

In fact, Marbury v. Madison seems to have not been cited _once_ between 1803 and 1887 It only became canonized by SCOTUS in retrospect between ~1887 and 1900, who used Marbury v. Madison as a rhetorical cudgel to justify their judicial activism scholarship.law.wm.edu/facpubs/115/
