A bit of a heads up here: I’ll be out of touch and offline for the next 10 days or so on personal business. Apologies that I won’t be chiming in on any last minute immigration issues before the election, but hopefully some of the other excellent people on this site will cover any gaps!
This is distressing to me, personally. Because I live in a neighborhood that was really struggling circa 2022, largely because of the struggling restaurant industry, which was struggling partly because of crime.
And it’s really struggling right now. Arguably worse. Largely bc of Trump.
Trump: "In Washington, all the restaurants were closing. People were being held up. They'd walk into a restaurant. Like Jesse James. 'Stand up! Give us all your money.' They're eating dinner at a fancy restaurant. All the restaurants were closing."
I recently had to block this guy because I found him to be one of the most bad faith legal commentators on X, who claimed to be an expert in immigration law despite little relevant experience, and because his follower base would flood my mentions with insults and ignorance. That made him really mad.
In a moment of candor, a MAGA legal commentator argues that it’s acceptable (even savvy) for the Trump administration to abuse the legal process with a meritless lawsuit to flood the zone with partisan electoral talking points he agrees with.
Cynical, but honest.
I expect 9th Circuit to dismiss DOJ's motion in California ballot case tonight or tomorrow, and for DOJ to file next at the Supreme Court, where they are likely to lose (if for no other reason that the district court will likely rule on the TRO before SCOTUS considers case)

Thread 🧵: the fraudulent transgender mailers have a connection back to Dallas, Texas, where a local Republican megadonor used a similar playbook years ago when he funded a fake BLM group to send letters to wealthy white parents that were designed to discredit the BLM movement.
CBS identified Illinois based Three Z Printing as the holder of the permit associated with the fake transgender mailers. One of the owners, Matt Zerrusen, is based in Dallas. His Instagram shows pictures with Charlie Kirk and Donald Trump, and comments from local Republicans.
The Justice Department's last-second letters about noncitizen voting contain people with no history of voting whatsoever, and they're moving so fast they sloppily sent one county the wrong list of names.
NEW, NYT: More action from the U.S. Attorney’s Office in the Middle District of California that is not based in law and runs counter to DOJ policy.
DOJ is threatening local elections officials in CA after DOJ did not get what they wanted from their BS lawsuit.

A key issue, however, is that local registrars can’t actually carry out these investigations easily; they don’t have access to any special database that has a correct answer to these questions, so as they have argued in court, they can’t do this in the general course of their operations.
I think that each CA county should comply and vet the list the DOJ has sent. A lawsuit will take too long; if they comply and go down the labor intensive road to vet the list, they will beat the DOJ at their own game. Some illegal voters will be found, but the number will be insignificant.
To conclude someone is not a citizen for sure, the local registrar may need access to birth certs, parents’ wedding cert, parents’ natz cert, custody history, documents whether parent(s) lived in the U.S. for a certain amount of time before the kid’s birth including 5 yrs after age 14, etc.

Yglesias says re: Minneapolis, as a defense against the idea that oppostion was wrong, that "I mean, what it took in Minnesota to turn that around, they killed multiple U.S. citizens."
That's true! But it also took Bloody Sunday and similar incidents to galvanize national support for civil rights.
A helpfully clear exchange here
Hasan: "So your argument is that [Minnesota ICE protesters] should stay at home because immigration is a salient issue for Donald Trump. Opposing ICE is only going to help Trump. Wait until we win the election in 2028."
Yglesias: "Yes that is what I would have said"
HOLY SHIT. In a sworn statement yesterday, an ICE agent told a federal judge that an ICE flight to Equatorial Guinea had been cancelled and so couldn't be used to bring Ahmed Soliman back to the United States.
The plane just landed in Equatorial Guinea.

* TRUMP ADMINISTRATION SUES TO BLOCK ALASKA SENATE RACE CERTIFICATION IF REPUBLICAN LOSES, CITING CANDIDATE NAME CONFUSION -- AP REPORTER ON X

NEW: After appealing Judge Carter's failure to rule on a TRO request (w/out mentioning the hearing date he set) in DOJ's "likely noncitizens" voting case, DOJ has now requested that Carter issue a preliminary injunction pending that appeal.
DOJ has now quoted SCOTUS's statement in a case over a court's inaction in a lawsuit challenging the Trump admin's efforts to rush-deport people under the Alien Enemies Act — when people could have been sent to CECOT without process — as a justification for its appeal here.
“Nobody is safe” under mass deportation, said Rep. @fernandez.house.gov.
More than 500 U.S. citizens have been targeted and detained under Trump’s deportation agenda. Some have even been deported.
Yet the administration continues to deny these abuses.

I’m not sure the Panopticon is still a relevant metaphor. The point there was that a concealed machinery of surveillance could make everyone behave AS IF surveilled, even though the watchers could only observe a few people at once. We seem to have effectively superceded that technical limitation.
The Panopticon was a thought experiment but the technology is now genuinely there to make it a reality and we have to grapple with what that means for us as a society.
/yes, I am aware that others countries had this debate and went with total surveillance decades ago.

Senior Fellow Aaron Reichlin-Melnick breaks down the myths that surround noncitizen voting, revealing that cases are extraordinarily rare and never impacted the outcome of a single election.

The deeper reason Trump, Vance, and Ramaswamy are backing the vile rape ad is they think MAGA politics—the cruelty, the depravity, the viciousness—is still ascendant.
They think doing this esesentially puts Trump on the ballot.

The Executive Branch has no authority to regulate states’ election decisions as to candidate qualifications, and the choice to file a lawsuit like this just days before an election speaks volumes about the political corruption festering at the top levels of the DOJ.
NEWS — The Trump administration sued Alaska over Dan J. Sullivan’s Senate candidacy, arguing voter confusion could affect the race between Sen. Dan S. Sullivan and Democrat Mary Peltola, per Courthouse News.
With citizenship approvals slowing, would-be voters are left in limbo: backlogs in naturalization applications rose from about 500,000 cases at the start of the second Trump administration to more than 800,000 as of August www.washingtonpost.com/immigration/...
Once mass spam texts were made legal, younger donors vanished, leaving a grassroots fundraising machine that subsists on squeezing vulnerable seniors, some of whom give hundreds of times a day. It’s a horrific model. Consultants get generationally wealthy, and the party hollows out its future.
We found that as of right now 73% of your campaign donation goes back to the consultants and vendors (!!!), four times more than just 20 years ago. Only 13% to ads. Even I was shocked.

“Departures from these practices should never be countenanced because they risk allowing prosecutors to impact national elections.” -Todd Blanche on DOJ’s 60-day rule, September 2024
Q: The typical practice is DOJ doesn't usually release charges this close to an election. Even though Ms Lucas isn't on the ballot, her daughter is. Can you speak to the timing?
BLANCHE: The 60 day or 90 day practice is not in writing. That's not part of the justice manual. There's nothing improper
Replace "Boeing 737s" with "empty warehouses" and you've got the same play that DHS under Noem pulled. And a source on background told us in February the sales were meant to help well-connected Trump affiliates offload industrial properties that were liabilities on their books.
