It can be perfectly legal protected speech to advocate for the overthrow of the government of these United States by force and/or violence. That doesn't make it a good idea.

Nah he's just talking shit. They're making an example of him, don't be so blasé about people being arrested for posting bad. I wouldn't post those things, but be for real: no one thinks he's actually advocating those things, he's just pissed off and expressing himself hyperbolically.

An indictment for vague, unspecified “threats from 15 months ago? This is weaponization to chill dissent, pure and simple.

I think states should expand Stand Your Ground laws to include defending yourself from illegal acts by law enforcement.

"Whoever transmits in interstate or foreign commerce any communication containing any threat to kidnap any person or any threat to injure the person of another, shall be fined under this title or imprisoned not more than five years, or both."

How does capricious application of law, enhance the 1st Amendment? I mean, I know I've posted various thoughts, while not pointed at a person or entity, would definitely qualify utilizing the criteria listed here, are utterances in absence of specificity and intent, are just speech aren't they?

/3/ Moreover, the statement here was unlike Counterman where the defendant had sent messages directly to the victim, so it could reasonably be argued, under the state statute charged there, that the messages were threats.

/2/ There are federal incitement statutes -- this supposed crime was charged under an inapplicable statute. Under Counterman v Colorado, government must prove subjective knowledge that his speech would put ICE agents in fear of harm.

My personal preference is that every anti-ICE comment puts them in fear because they should live in fear, and they should for a very long time as they are hunted down and called out for their crimes.

/1/ The Bluesky posting is not a "threat." It is incitement, and cannot be unlawful unless the government can prove that the alleged unlawful acts were both imminent and likely (per Brandenburg v. Ohio).

Better authority is Elonis v. US (2015) dealing with the same statute in which the mens rea is established as "knowing it would be interpreted as a threat". Oddly not alleged in this indictment.

I don’t think the point is to convict. It’s to punish political enemies by tying them up in the system for 6 months to a year. But I agree. STOP HELPING THE FEDS BY POSTING STUPID SHIT ON THE INTERNET.

I have said multiple times that anything you do to defend yourself physically from ICE detainment, and anything that happens as a result, is a better fate than letting them take you where they want to take you. I said it again and will continue to stand by the aforementioned sentiment.

Those who can’t afford to fight frivolous charges in court should rightfully resist going, law enforcement has no credibility left, especially in this regard. Don’t be a victim to the abuse of the law by partisan operatives, don’t become some cops fucking paycheck, “fight like hell”.
