No, it is not legal to open someone's personal device without probable cause or a warrant in the USA. Citizens are not required to show their personal devices to any federal authority. And by attempting to force someone to open their device, they violate the law and should be reprimanded.

Where were the arrests when the Secret Service wiped their phones evidence regarding J6. New software updates....MY ASS! Crooked fuks protected that POS traitor. Anyone believe that was just a coincidence or bad timing wiping their phone systems as to who all was involved in the Secret Service?

Government going after a private phone while it CONTINUES to use Signal, in direct violation of the government records retention act, government communications that BY LAW need to be retained, magically disappear, but let a private citizen protect his info and throw him in jail!?!!! Fuck trump!

What kind of idiotic organization governs this country? Does everyone have the right to protect their own interests, or have we already reached a point where we are destined to experience a repeat of Germany 1933!

I don't know you could HAVE a duress password...now I have to look into doing that. btw...it's his phone, the government has no right to look at it without a warrant.

a 'duress password' should be standard on every phone: “We all have a right to secure our private data against unconstitutional searches. And we should – especially in a time of rising authoritarianism.” www.theguardian.com/us-news/2026...

Bad decision on his part. He could have refused to provide the passcode, at which point authorities could have seized his phone (no basis for doing so required at the border). Having your phone taken would suck, though. If he really didn't want them to see data, he should have used a burner phone.

We are traveling internationally in Nov and that is exactly what I am doing. I’m not afraid of the country I’m going to trying to illegally search my data, I’m afraid of this country doing that when I come back. That’s a sad statement but it’s true.

Just disable faceid and fingerprint access & put an alphanumeric 12-digit password on it and tell them to get fucked, because you cant be compelled to give your password. If you’re a US ctzn , they can’t deny you entry. The most they can do, w/o prob.cause, is make a copy of your phone’s memory.

Get it locally and then a SIM card for the country you are traveling to. There are articles about the what SIM cards are suggested. Only load apps you will need and travel related documents etc. do some research so you will get everything you need.

I'm a lawyer who travels frequently for leisure. During the years of Trump, I've resigned myself to the idea that any attempt to seize my phone (which has access to 16 years of client emails and is a path into about 30 years' worth of confidential docs) is going to result in me catching a charge.

Typically, pre-installed email apps use only internal data, but some 3rd party apps allow you to store email on SD card. Then, before you get off the plane, turn off your phone and remove the SD card? Alternatively, is attorney-client privilege limited to US soil? Yours could be interesting test?

Where’s the crime? The trump DOJ can defy court orders, why can they search your phone without a warrant in violation of the Constitution?

Yeah, good luck on that case! I’m getting more and more disgusted with law enforcement in the United States. Agencies that are supposed to protect citizens and defend the rights guaranteed to them instead seem to do everything they can to undermine their own departments and break the law.

I just don't see it. CBP can't prove that any evidence of anything was destroyed—that's apart from the fact any "alleged evidence" was destroyed by the CBP's own hand.

Social media doesn't live on the phone. Can't we just delete the apps and clear local data/cache before going through customs and reinstall on the other side?

I am very confused about this situation. It is illegal to wipe your own phone? What would make that illegal? Are they arguing destruction of evidence? But how would they know it was evidence? Quite confused.

If you feel safe from all this seizure, don’t be surprised when your name is called to ride to a camp. The incompetence of trumps WH makes so many mistakes happen.

That should be a standard feature on phones bc ppl have so much PII on them. The guy searching your phone obviously doesn't trust you, so why would you trust him not to steal your identity?

The phone, and everything on it is his property. Does he not have the right to dispose of it as he sees fit? It would be one thing if he had already been charged and was disposing of evidence. But the destruction in this case is the charge?

The border of Russia?¿ If US, what possible charge can that be??? Do we need to issue a copy of the Constitution, including the Bill of Rights to ice thugs??? Apparently, they must've gone to "private" school! Imagine if they had an SAT SCORE requirement! We wouldn't have to worry about ice thugs!!!

"Tunick’s case also raises ongoing questions about what constitutional rights can be invoked at the border, which the U.S. government has long asserted is not U.S. soil until a person is authorized to enter." As a citizen, I need to get permission to step foot on US soil?

4th amendment violation. They will use the constitution as a weapon against citizens, but ignore it when the government and president violates it. USA is not a real country.

American’t citizenship doesn’t exist when “citizens” don’t have the right to enter without unlawful seizure of property, the regime is working on denying legitimate access to voting, and public services can be de-funded for political reasons.

TBF, the ONLY way to protect any semblance of privacy is to be a Luddite. ANYONE who uses the internet FOR ANYTHING has already had their data hoovered up by data brokers, Peter Thiel & all similar bad actors, governments, etc. The disease is humanity & collective MENTAL ILLNESS!

You are not officially in the US until you pass through the CBP checkpoint. US laws don't apply, this your only recourse is through your government. The US has become Russia and Israel. For the most part a duress password requires a different OS on an Android phone.

No, when you are here, you are here. Period. There is no limbo part of an airport where your Constitutional Protections don't apply. This is simple, if they can demonstrate probable cause, they can seize your phone until they get a warrant if you refuse to unlock it.

Catch 22 indeed. If it happens in a different country you would call the ambassador or attaché, since you are waiting for permission to enter the US call you congress person's office.

"The government’s indictment, which contains a typo (“Untied States Code”)" By gawd those idiots at the DoJ are so persistently inept. 🤦

Don’t forget to say it was also without a warrant they said they were gonna take it without one which they can’t do and that’s his personal private property and they have no right to it!

It should be our right, our phone messages are none of their business. This is the dump regime taking another right from us. dump and the GOP are fascists, this is what Hitler did, silence they people you don't like.

With Samsung Knox you are safe from this. Just keep your private data on the secure encrypted Android side and give anyone access to your main phone side.

Why were they stopping him a taking his phone? Is the man a known criminal? What was the justification for charging him? They had no warrant for personal property.

Your 4th amd rights apply here and they cannot force you to open the phone, nor can they charge you for exercising your Constitutional Rights. The hook is that they can seize your phone (with probable cause and refusing to open it is not PC) if you don't unlock it and let them look.

If you are genuinely concerned about this issue, mail your phone back home to you before flying, or, buy a burner phone you don't mind not going back for. This should be rare. They have to be able to show there was clear probable cause if/when you sue. Most people won't sue and they abuse that.

If you are under the jurisdiction of the US, you have Constitutional Rights, there is no limbo area that is on our soil but our rights do not apply. IMO this guy was probably making a point, and being harassed by the local police over his repeated protesting of Cop City.

That is the way it should be, however there are several jurisdictions, and several Court opinions that challenge this. Their reason being that if you are not on our soil, and if you haven't crossed the border into the USA you aren't, constitutional rights do not apply.
