King James II’s reign and the Glorious Revolution was supposed to enforce the general idea that the executive cannot suspend the laws of the land and must faithfully execute them. The US as an intervenor in a citizen EPA action has filed a crossclaim seeking a declaration that the US can dismiss the NAACP's (or any citizen) EPA complaint. Among other things, this is unusual because the district court this past week just held that the US has no right to dismiss the action.
