Lots of talk here about giving a replacement nominee the McConnell treatment. Which one? Given current Dem Senate leadership and razor thin majorities, which is more likely to succeed, the GOP doing the Barrett variation in November or the Dems holding a Garland for two years?

Here in Denmark I think there has been 3-5 decisions in supreme court the last 30 years that were somewhat political. Changing laws or political decisions. (And nobody though they were influenced by personal views of judges). It seems absurd to me that nonelected people have so much power in the US

Danish judges are selected to the surpeme court by a nonpartisan board of mostly judges, although officially appointed by the head of the justice department. I dont remember anybody ever complaining about the selection.

They better be careful. Republican carnage can continue in other elections. They might even be obliterated as a party. Fulfilling Lindsey’s 2016 prophecy.

Whoever it is, Alito was such a fan of Shitler, and against the Constitution, that the next one can't be much worse. But with the Dems in charge in the Senate, maybe they can stop a crazy like Cannon, from getting confirmed. Only time will tell.

We threw a tantrum in 2024 and this is the consequence. Thomas will also step down in November if Democrats win. The only way to fix the court is to play the long game and put real fixes in. That means expanding, term limits and insisting on a minimum standard of ethics.

I think the article is pretty clear that he plans to stay on for at least one more session. That’s great news, and let’s just hope he doesn’t change his mind in November.

What could make this interesting: the OH and FL elections are special elections and the winner will take office before January. If Dems flip those, the Senate will be 51-49. A Murkowski and Tillis defection could potentially stop a GOP nominee. Both are in states that could elect D Senators in Nov

I think you have that backwards: If the Dems *fail* to win the senate, expect this retirement and then the Senate GOP will jam the next person down our throats. Otherwise, Dems can just do a McConnell.

Democrats could obstruct a lame duck process in several ways, such as: • Prevent unanimous consent • Keep the nomination in committee • Use procedural delays on the Senate floor • Refuse to provide a quorum

If the Dems win the Senate they should play a page out of McConnell’s playbook and refuse to consider any nominee. Leave the seat empty.

Yep that is the concern. They will amazing get through committee and hearings and a full vote and warp speed. Weird they couldn’t do that Obama’s last year.

Mike Lee (traitor senator from UT has been jonesing hard for this position. He has completely turned his back on his constituents. Former tea party member and “constitutionalist” lawyer (ask him about his pocket constitution). If he gets that nomination I may well move to Portugal

I've been expecting this one and Thomas to retire prior to the election, that way they could have jammed through a couple more of their "like-minded conservatives". But with the House on recess until after the election...

Well then they can impeach the other five and it won’t matter. And let the R’s know that’s what will happen if they replace him

The fact that he announces this right before midterms show how blatantly partisan he is when scorus is supposed to stay out of these things. I’d also worry for the signaling he’s giving about what happens if midterm election shenanigans go to scotus.

McConnell stopped it, so can the new majority leader. They had better because if the Dems bend then it’s over, they’re no better than GOP. That’s why people are pissed because most elected officials are bought and paid for!!!

Well, it could be instructive, to have a Democratic Senate interrogate Judge Cannon about, oh, some of her more recent cases. And then vote her down. That could be fun.

Republicans failure to address healthcare is how we reflexively got Obama care. If they jam a SCOTUS replacement down the Senate's throat, we're much more likely to see an expanded court after 2028

If by any chance Cannon gets nominated and confirmed, a Democratic majority Senate should impeach and remove her for her blatantly partisan performance in the District Court. Hell, she should be impeached for that regardless.

Well Mitch McConnell, before his death and reanimating through black magic, showed them how to block an appointment to the Supreme Court years ago with a minority, so….

Then, the Dem senate leader, presumably Schumer unfortunately, should try to shut it down like McConnell did when Obama nominated Merrick Garland for SCOTUS. That also stuck us with Garland as Biden’s Attorney General - and we all know how that worked out.😡👎

When Dems regain control of Congress they must make desperately-needed legislative changes for all 3 branches of gov (SCOTUS term limits ETC) Having a conservative majority in both Congress & Supreme Ct is dangerous as hell for the country.

He may very well do that, but this headline is irresponsible (and has appeared pretty much the same in several outlets), as the very first graph of the article says he is thinking about it after the next term. Maybe he thinks it will help Republicans survive the midterms (lol).

Needs to go for sure! Also if Dems win don’t new justices need Senate approval? I think a Dem majority would just run the famous ‘Mitch play’ and say oh sorry you’ll have to wait until the next Dem President gets in to have anyone but our choices get approved to SCOTUS. #FUCKTRUMP
