DHS employees entered our store this afternoon and served us a Notice of Inspection, demanding copies of I9 forms for each employee. In 27 years as shopkeepers, we have never been subjected to this type of investigation.

Could you not simply throw that in the paper shredder and warn them never to come back without a warrant signed by a judge?

We aren’t, we are in the USofA, this is 100% American and we need to stop the compassions now. We need to recognize that this is us and we need to clean this up once and for all, we should have a long time ago fwiw. This time we do it right and jail these fuvkers, yes?

Yep, if you *had* to make a comparison, all of US history from 1800 to 1960 would be pretty relevant. I’d highlight the years leading up to the Civil War, the late 1920s, or the Civil Rights era, but this is very much an American experience.

I’m going to go ahead and advocate for coming down on these KKK wannabe warrior troglodyte fucks with the full and complete force of law. We’ve saw enough by 1800 to know that these people deserve to be held accountable for their actions, and that accountability means *significant* consequences.

Heads up! If you are a business owner, and have employees, keep their Records in a locked safe. Do not share them. I’m retired, but I can tell you, if I was employed today. I would insist and demand that my employer, never ever, ever, share my information with anyone else. This is incredible.

The feds already have info on file of I-9. They routinely check on those in that system but I assume they just do it and not in this manner. HCMC was subpoenaed about I-9 employees after big pushback against ICE behavior in hospital. 100% Retaliatory

I would imagine that the power of audit exists in the event there is a (seeming) discrepancy ("you have 22 employees but we only have 20 I-9s"), and that that's not the case here. But I speak from experience as a naturalized immigrant that DHS excels at demanding paperwork and then forgetting [...]

I still would not comply. Make them use their bully tactic. Makes for really bad press for the DHS and they know it. But, that's me.

This is incorrect advice. This is an I-9 audit and requires 72 hour response or a business can face business ending fines. Please delete this. I'm a lawyer and this is misinformation.

Update: Thank you to everyone everywhere for your support! Our focus is always local! If you're outside MN, please support your local toy, game, and book stores right now. This is a stressful time for all of us! Or we'd encourage a donation to your local immigrant rights advocacy org. Thank you!

Given the timing, we consider this to be targeted harassment as punishment for exercising our First Amendment rights. We're still handing out free whistles. And we just got in hundreds of new yard signs. Keep resisting, Minnesota. We love you.

This certainly seems like the subject of an FOI request. "How many I9 audits have been performed in the city by month and market sector." If you are the only you store them it's straight up retaliation. I'm sure there are plenty of lawyers here who could help.

Mischief toys is fantastic- I stopped in for stickers earlier today and I absolutely believe this is targeted and an attempt by DHS to intimidate. Mischief is wonderful and we will support it all the way!!

We mostly just sell in our store but we offer curated gift packages at mischieftoy.com. But honestly every small biz is stressed right now. If you have an indie toy, game or book store near you, you should totally hit them up! Thanks! 👊🏼

Harassment is the name of the game. Trump and his cohorts do not want opposition - any opposition. The temperature is being ramped up so that even more severe action can be taken leading to the shooting of opposition. The Insurrection Act will be invoked. It is just a matter of time.

Perhaps unpopular, but ICE has the authority to demand a copy of a businesses I-9 forms. The business has three days to turn them over. I suppose after that would be a subpoena. Although this might be targeted, this is the actual job of ICE.

As a reminder to other businesses, the *only* document that allows DHS (or any other law enforcement) to enter the private areas of your establishment or to inspect your records is a *signed judicial warrant*. This “Notice of Inspection” might as well be written in crayon on a napkin.

My name is on 1000's of I9 forms as the employer. There is no penalty for the employer other than falsifying his own name. I had 2 Jose Contrase, with consecutive Soc #.

IANAL but others in the thread have clarified it’s notice that the employer has 3 days to produce the records for inspection.

These notices can be issued to any employer. Review www.ice.gov/factsheets/i... You usually have 3 days to respond so use it to go over your I-9 forms, make sure that any errors are corrected properly (note that some errors can’t be corrected). Talk to a local immigration attorney. Also F ICE

Fuckers. We’re doing the same thing down in Red Wing at Rivertown Games. They haven’t bothered us yet, but they HAVE tried to intimidate other likeminded businesses.

You mean the government can legally walk into a private business and demand to see proof of citizenship documents for their employees? Sounds pretty fishy to me, if that’s legal we need a new constitution.

It's quite real and enforceable without a judicial warrant. Basically an I-9 audit that any business is subject to at any time. Requires a 72 hour response so please don't tell business owners it's not real. It very much is.

I hate what ICE is doing these days. It repulses me; however, having been an HR manager for 25 years, I9 audits fall under ICE’s purview. If the forms were filled out and filed properly, there’s nothing to worry about. I lived in a commercial fishing area years ago, and I saw a lot of this then.

So it's "show me your papers" but for entire businesses. How soft can these trump cucks get? Total pussies. Grown men with weapons of war letting words of love and support trigger them. Smh. Fucking nazis.

It doesn't need to be. This is HSI, not ERO, and the Notice of Inspection requires the employer to provide copies of Form I-9 of all current employees and ones who have left in the past year. It's low-grade paperwork harassment, no agents entering the property. Failure to comply might provide PC.

Let me qualify my earlier statement (damn character limit): no agents need to enter the non-publicly accessible areas of the business. Still, wow. Is the mail not working in St. Paul or something? (To be clear, I agree that this smells like a legal power being exercised for the wrong reason.)

Any chance you guys ship stuff? I'm not in your states but would love to buy some stuff to support you. Or I can just do what another poster said and buy a gift card in way of a donation to your store to buy/make more anti-ice stuff.

All - I'm seeing a LOT of misinformation in replies to this, and I just want to repeat what I've replied to a lot of others. PLEASE stop saying that you know what the law is if you don't. This is an I-9 audit and requires 72 hour response or a business can face business ending fines.

Who doesn’t file an I-9 for each new employee? It’s been the law for years. You have to keep them for three years. I don’t even know why you’d need 72 hours to respond

Uh… You know there’s a whole grey and black market all around you right? Restaurants (front and back of house), retail, factories, landscaping, construction, agriculture, day laborers, gas stations, car wash places, mechanics…the list is endless. People working under the table all over….

Also, it is not outside the realm of possibility that some of these responses with people telling business owners this is not enforceable are not just armchair lawyers but deliberate misinformation providers.

Right. I9s do fall under ICE jurisdiction. HR and business owners should do a self audit NOW. The form isn’t the most straightforward thing; it’s easy to make mistakes. Self correct is permissible.

It's possible that some of the people responding are deliberately providing misinformation. But I think most people have good intentions. A lot of people are totally fed up with ICE and what it's doing in Minneapolis and elsewhere.

They started these with immigrant owned businesses around December here in Minneapolis and have worked their way up to HCMC this week. So ridiculous and retaliatory. If you have any questions about responding I’m happy to help, I’ve assisted several folks on this side of the river with them.

No, any business could possibly be audited for I-9 compliance at any time, and you have three days to respond. It's just REALLY coincidental the way that's been happening here. (Note the sarcasm).

If you're not fighting fire with fire, then you're not fighting to win. Report every Republican owned or Republican donor owned business to the IRS and DHS. Flood them with reports. Tyson, Tesla, Meta, Brooke Rollins, etc. all need reported on a daily basis for hiring violations.

It’s one of our favorites! It’s a party game where you get to rank things and everyone else tries to guess your rankings. Any cards they get in the right order helps to spell Priorities.
