If you accept that non-citizens have no right to due process, you are accepting that citizens have no right to due process. All the government has to do is claim that you are not a citizen; without due process you have no chance to prove the contrary.

I think that judge is. He’s trying to establish that the administration went against his orders (told them to turn the plane around and they didn’t), but they’re coming up with bullsh*t reasons to not reply. I hope Judge Boasberg cites them for contempt.

I’ve been looking at the history of Magna Carta. Hadn’t realised how much it influenced the Declaration of Independence and the US Constitution, or how many members of the Inner Temple in London were signatories.

Not the government's approved citizen. They'll come for your parents weren't US citizens; or trans citizens; or even "disloyal Democrat" citizens; or who knows what category that they don't like.

The Bill of Rights does not mention citizens. These Constitutional Rights (including due process) apply to everyone wherever the Constitution of the United States is en force.

Try telling that to the inhabitants of Guantanamo Bay, or the Afro-Americans who where subject to the JIm Crow Laws. Under Trump The United States is simply becoming more and faster a villain state than it is was before, but it was far from prefect before Trump joined the game.

Yes. Sadly, it applied to "free persons." When slavery was abolished, it applied to everyone. Undocumented immigrants are free persons, they are not the property of anyone. Plus slavery is now illegal.

lol no not free persons "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

FWIW: Tthe Constitution mentions "citizen" 11 times (usually in relation to definition and acquisition of same) and "person," meaning the rights and obligations of ANYBODY living in US jurisdiction, 22 times. The Constitution considers "persons" very real, and invested with protections.

Not even “living” but merely occupying space on US soil, which is why asylum seekers are so desperate to make it onto actual US territory. Of course, we’ve eliminated much of those protections by granting CBP unprecedented search & seizure powers, which should be rescinded ASAP.

Too many people won’t understand this simple truth until it affects them. Until someone they know, can relate to or see as themselves, is taken then it won’t seem even remotely possible. Repeating it helps, but it’s easier and quicker to learn if it’s shown to them.

"I have a green card!" "It's been revoked." They said, to a man married to an American Citizen in front of his wife, then hauled him off across the country 1000 miles from the relevant court for his case to be heard. It's already being done.

As a Canadian, I can't enter the US and criticize Trump or anything happening in the Middle East. I wouldn't be able to criticize Elon Musk nor suggest a boycott of Tesla cars, including the Swasticar. I wouldn't be able to criticize the MAGAts who voted for Trump. I could be sent to El Salvador.

This is not something you want to fafo with - this eia and other specious eo’s the admin is putting out to illegally deport people will absolutely lead to citizens being deported

I just don't think in a civilized country there is literally any reason to get rid of due process. There is no reason I can think of to get rid of that unless you want to do some extremely heinous shit. There is no reason anyone should accept anyone not getting their fair day in court

First they came for the Venezuelans. And I was not a Venezuelan so I did not speak out. Then they came for the Cubans, then the tourists then the Italians, then the Irish, then Democrats, then the poor, then.... Ignoring legal rights is a danger to all. . www.theguardian.com/us-news/2025...

I actually had a vivid nightmare that I was being detained because I didn't have my papers in order, and in the nightmare, Canada had been invaded and everyone was forced to wear stars and stripes, but no maple leaves allowed. It's terrifying to think my nightmare could happen for real. ☹️

Or do as the UK did, and state that as you have the right to claim citizenship elsewhere they can withdraw your citizenship and abandon you. See Shamima Begum, who was 15 (a minor) when she was groomed to go to Syria and has had her citizenship revoked.

And now that legalistic maneuvering has finally expanded beyond suspected terrorists, as anyone with a brain and a moral compass said it would. People are now criminals if the White House says they are, and no need to see the evidence, evidence is woke.

I remember how during the Bush years, people kept insisting that suspected terrorists had no right to due process because they were illegitimate combatants, neither civilians nor proper military. The whole point being that human rights could effectively be erased through legalistic maneuvering.

Starting to sound like pre-war Germany? Many, many Germans felt the same about justice and due process. They hated their Nazi government. But, by the time anyone acted, the echos of anguish could be heard following behind Nazi boot-stomping through Europe. Are we going to unleash fascism?

This point is so clear and obvious that it’s mind blowing to me that this isn’t front and center for everyone at the Trump administrations claim it can do what it claims. Its terrifying

This president operates entirely on whims: tariffs, taking Greenland by force, attacking law firms that once worked against him, banning rNA vaccines. We are being led to our doom by a 4-year old with orange pancake makeup.

So true! Our challenge is to find effective words and fora to help educate people to concepts like due process. Many ears shut during civics class. Write off the 10% cultists … I believe the additional 39% Americans who voted for DT can eventually be helped to understand his destructiveness.

The only constitutional rights that are exclusively for citizens * are the right to run for political office, sit on a jury, and vote. Everything else: free speech, right to trial, jury, lawyer, due process, etc. apply to "all persons". * it's possible I am missing one but I don't think so.

14th amendment, section 1. While it references citizens in the prior statement, where it mentions due process explicitly it says "any person". And jurisdiction is anyone's who would be subject to the laws here (not diplomats/invading army). So yes, constitutionally, even non citizens.

Where in the Constitution does it say “some of you” have the right to: innocence until proven guilty, protection against illegal searches, a fair trial, protection against self-incrimination….etc etc etc? It’s a STEEP downhill slope.

Is it fear mongering to point out which citizens will be profiled? Take a guess why those "many citizens" happened to be arrested and then released. This creates 2nd Class Citizenship where some Americans have to show proof while others never do.

Seriously? After the past 3 months? We have been told at EVERY STEP: “Oh, they couldn’t do that!!!! Even if they tried someone would stop them. DON’T GET HYSTERICAL! Stop reading that liberal lying garbage!”

I know that this country has a history of violating rights, even those that we purport to hold dear. I had hoped that we as a nation had gotten past this destructive behavior.

The administration has already crossed that Rubicon by claiming: - If you hurt Tesla’s feelings, you can be unconstitutionally disappeared to El Salvador (Trump tweet) - If a random white woman is murdered somewhere, you can be disappeared to El Salvador (Homan interview yesterday)

A famous dictatorship could serve as example here, if it weren’t for the fact that nowadays too many see said dictatorship as the good example, they would like to have to be followed. „Forth haste I, not with thee to perish And spoke‘t and swiftly sailed to sea.“ Friedrich Schiller

Asylum seekers should be entitled to refugee status. To get that status they should be allowed to put their case in court, so even without the whole fascist shoebag Trump is abusing everyone should be entitled to say "wait a minute, I want to see a judge and explain my case".

Yesterday, a federal judge on the DC Circuit Court of Appeals agreed with you 💯, & you won’t believe how she explained it in the hypothetical, because it is shocking. In fact, shocking to the conscience. Judge Patricia Millett an amazing judge.⚖️

They're certainly testing the waters. At least during The Red Square they had an enemy to (falsely) persecute folks. Now it's just 'I don't like you'! I think it's 𝘮𝘰𝘳𝘦 dangerous to 𝘯𝘰𝘵 have a distinct (if imagined) enemy to accuse folks of belonging to, this tells 𝘦𝘷𝘦𝘳𝘺𝘣𝘰𝘥𝘺 to stay silent 𝘰𝘳 𝘦𝘭𝘴𝘦!

Soon, you'll start hearing stories of citizens without ID, getting picked up, accused of being a non-citizen, & sent off to a jail like the one in El Salvador. Don't leave home without your (Aryan) racial identity documents! #HistoryRepeatsItself #BeAware #Resist

Little Trump makes America smaller & smaller. We have been a giant upon the stage, WWII, one Atlantic hand & one Pacific hand molding a world. The UN, all nations, come to our home to talk. The Orange King wants isolation. Allies shunned; Adversaries hugged. Down, down.

The same will apply to trying to force “prove citizenship to vote in federal elections” - women w/ a maiden name? Imagine the “that’s not you” shtick they could use… In full, trying to “trump” due process this is dangerous very broadly, cannot be acceptable at all. slate.com/news-and-pol...

slate.comWe’re Finally Seeing the “Evidence” Against the Migrants Deported by Trump. It’s Unbelievable. The Trump admin said a soccer player had a gang tattoo. It’s a tattoo of Real Madrid’s logo.

Good luck trying to prove your citizenship if you're 18 and finally eligible to register to vote. Unless you've been overseas, you have no passport. Birth certificates don't count. Many 18-year-olds don't even have drivers' licenses and won't need a "legal" photo ID til drinking age - 21.

People really don’t seem to understand this, or they think it’s irrelevant, until something terrible happens to them. But by that time, it’ll already be too late. What it will take to break this regime? Until the people understand the magnitude of what’s happening, our democracy will fail.

Also - hey rest of the planets nations - block americans entry to all your borders! Keep every American contained within their own borders - and make Alaskan traveller's go around Canada - until they remove their so called government

Right. Same with Laken-Riley. What's to stop an LE officer from stopping anyone on grounds of "suspicion" of being illegal? And threatening not to straighten out the paperwork. We're in a dangerous time for everyone, not just undocumenteds.

Anyone can be stripped of citizenship if deemed treasonous and also receive a prison term after a trial. With current confusing of treason with dissent, the bar is low for being accused of committing treason. Skipping trials or hearings and going directly to a foreign gulag seems standard practice

A few months ago, I hit a wall, mentally drained, creatively stuck, and so over the 9-5 grind. So I started digging into burnout, and exploring it deeper. If you’ve ever felt burned out (or close), I’d love your input. 📝 Quick survey (5–7 mins): cwafrp2nthb.typeform.com/to/if38RUOt

And we forget that there is historical precedent for this. See Eisenhower’s Operation Wetback (yes, that’s what it was called), which deported US Citizens of Mexican descent because of the lack of due process in the roundups and expulsions. immigrationhistory.org/item/operati...

immigrationhistory.orgOperation Wetback (1953-1954) - Immigration HistoryEven as the bracero program continued to recruit temporary workers from Mexico, the Immigration Bureau led round ups of Mexican nationals. The Bureau claimed to have deported one million Mexicans.

This. The ENTIRE it can't happen to me because XYZ is predicated on being able to claim/show/prove XYZ. Joke's on you. If I grab you off the street, ignore your screams, and ship you to a foreign prison, HOW do you prove you don't belong? DUE PROCESS IS ESSENTIAL!

That is the kind of control this regime wants. They want to be above the law so they can end our democracy and the freedoms only a democracy can provide. These people intend to make U.S. an Autocratic Dictatorship!

If you think anyone should be deprived of due process, you support fascism and you don’t believe in America and our Constitution and the rule of law! “First they came for the socialists…”

The sociopathic fascist GOP, Trump and Musk do not care about destroying lives, sending innocent people to hellhole torture prisons, … They have no honor, no morals, no sense of duty to America and our democracy! They lust for unending and unfettered power and to steal from us all! They are #evil!

Though most people characterize the Bill of Rights as rights held by citizens and those under the jurisdiction of the US, what it does is curtail the ability of the government to violate the unalienable rights those within its borders; it puts the brakes on violations by the government.
