Speaking of shut the fuck up Friday, I’ve been seeing some people say that the FBI has contacted them for questioning after seeing social media posts, and my extremely urgent advice is that you should under NO CIRCUMSTANCES talk to the Feds without a lawyer.

So if a Fed is watching Fox & Friends in the morning maybe they should get busy like they do with unarmed suspects sleeping at home? Maybe kneel on something? They could apply the same rule to members of Congress

People lie all the time without really thinking about it—minimizing their actions or revising them without thinking. Or the Feds could decide you’re lying even if you haven’t, and now you’re being charged with a crime. If you say absolutely nothing to the Feds, you cannot lie to them.

They will ask you a bunch of questions and then ask them again and if they *think* you said different things each time, or that you and another person said inconsistent things, they can say you lied and charge you. And the evidence will be their hand-written notes and their partner’s confirmation.

They want you to believe that if you’re nice to them and explain yourself clearly and at length, you are more likely to get off. This is completely backwards. DO NOT TALK WITHOUT A LAWYER.

OK I have a question. The times in the past that I have talked to an FBI agent, it was twice and for the same reason both times: they were doing a mandatory background check on a friend of mine who was in the process of being hired by the Foreign Service.

Both times I'd agreed (in a conversation with the friend) to do this (answer questions about that friend to an FBI agent). Was this a bad idea? If it's generally OK, what guidelines would you give people with friends who are trying to get jobs that require FBI background checks?

I have done this as well for folks in other federal jobs. This is part of the security clearance process. It's not the same as a criminal investigation, especially one that could affect you as well as the other person.

…unless they have a signed warrant or have forced their way in. If the door is open and they stick a foot in, they are legally in and there’s nothing you can do. Just say that you do not consent to the search but will abide by the warrant.

“If you cannot afford an attorney, one will be provided for you.” A public defender may not always be the top of the line, but it’s absolutely better than no legal representation. And you don’t have to have a lawyer to invoke your 5th amendment rights and STFU!

They must also articulate the specific crime they are suspicious of. You will hear obstruction of a federal investigation first its bs to scare you. If they had a crime they would arrwst not question

If they want to talk they come get you. They are allowed to lie to your face. They have to stop asking questions when you ask for an attorney. They can hold you for 48 hours for questioning 72 hours if suspected of a crime. DONT SAY ANYTHING not even your name. Stay safe know your rights

Also remember: the federal bureau of idiots used social media to find BLM protesters who hadn't committed any crimes and arrest them purely to intimidate them, and then Chris Wray told Congres that the FBI wasn't ready for Jan6 because it wasn't authorized to use social media posts to fight crime.

The FBI has the time to comb through people’s social media posts and hassle them about them…meanwhile trump and his criminal mob are waltzing back into the White House!

My wife likes to watch police body cam videos, and so I end up watching them too. People always just make things worse for themselves. In many cases the only charge they get is resisting arrest without violence (an absolutely absurd sounding crime), or obstruction.

That goes for ANY law enforcement. Law enforcement are ALLOWED to LIE to you. Law enforcement are NOT your friends & are NOT looking out for you & I'm saying this a privileged white women. Say it over & over until it's burned into your memory. SHUT THE FUCK UP! Say NOTHING EVER but "I want a lawyer"

You should never talk to ANY law enforcement at all or answer ANY questions about anything you’ve seen, done, people you know, places you’ve been etc. without having an attorney present.

We got a phone call from the Capitol police when our 15-year-old posted something thoughtless online and oh yeah we politely said we'd have our lawyer call them back not having my minor child talk to the feds w/o a lawyer nope nope nuh-uh

Look up what people got locked up for during the Red Scare, look up how people got around those laws, and see how you can do the same in modern times. I promise you the first amendment won't help in McCarthyism 2.

Let's be real here: if someone claiming to be the FBI calls you on the phone to talk to you about a social media post, 9 times out of 10 it's a scammer. Don't even bother calling a lawyer unless they show up at your house with a warrant.

I had a job which involved security clearances, so we occasionally got interviewed about coworkers. One year's renewal I did get asked about my involvement with the "Libertine Party", and had to clarify that I hadn't been invited to any, but the Libertarians had come in third in the last election.

FOAF had a story about the clearance investigators telling him the candy store in the Bronx he claimed to have worked for denied all knowledge of him, and had to call his dad to tell the owner it was really just about his clearance for the Air Force, not the numbers game in the back room.

That's ridiculous. People are allowed to blow off steam. It's not like this failed society prioritizes care for mental health. This is our outlet. Fuckers.

I wouldn’t talk to the FBI with a lawyer or without. 🖕🏻em . I’m sure there are more important things they should be investigating. The unholy one posts crazy shit breaking laws and nobody is questioning him 🖕🏻em

One of the greatest things in my adulthood, was driving home from work and was randomly pulled over. The cop said he "smelled pot" (I honestly quit smoking like 20 years ago so it was BS), and asked if it was okay to search my car. Told him "get a warrant". He just walked away and drove off.

Out of curiosity, would this advice apply if a Fed-driven vehicle t-boned your vehicle at a 4-way stop, in such a way that they were clearly at fault?

People seem to think they can talk their way out of trouble. Really, you can only talk yourself INTO trouble. Your forefathers fought for your rights. Try using them

Even if American feds tried to contact me I'd make them come to my fucking doorstep in the middle of butt Fuck nowhere Canada. And even if they did, they're authority is not recognized here in "Fort Kickass". American feds can suck a hockey puck through a hose head for all I care.

2 men in suits stopped us & took us to a couple rooms to ask us separately what was wrong. This was 1967-one of Mike’s friends was AWOL from the army. They never identified themselves & started asking about the AWOL friend by name. We both shut up and asked to leave. They let us go.

I was interviewed once by the FBI. I was not the subject of the investigation, they were just gathering information. Even so, it was uncomfortable to have that level of scrutiny on me and what I knew. I never, ever want to be interviewed by the Feds again.

or even with a lawyer unless they're actively charging you of anything and even then don't say a thing period let your lawyer do all the talking if any talking is gonna take place at all

On a more serious note, this is a good reason to stay away from biometric security on your devices. They can physically force a fingerprint or eyeprint from you, but a long numeric code committed to memory is a little tougher to obtain :)

I sat on a jury once. The tape of the defendant speaking to the cops is why they were convicted. If they would’ve just shut up, the outcome may have been different.

I don't see how that would work. Trump can't just change long standing laws and processes on a whim. He would have to get things through congress & possibly the courts. While both of these have Repub majorities, they aren't enough to get all the votes he would need and sometimes decide against him.

We should take a lesson. Had we not marched, Vietnam War for many more years and lost lives. We are now lazy asses. WANT TO END SANE WASHING? BOYCOTT CNN Start at 12:01 am Jan 19th and continue until 11:59 pm Jan 20. Gives people enough time in advance of inauguration to get comfortable

No need for that last part because if they have the goods to charge you with anything and you can't afford a lawyer, you get a public defender. The guidelines are simple. Just say no. No additional context, no additional information.
