I mean, clearly in this scenario Dracula has a potential defense: as a dementia patient, he cannot be expected to know right from wrong. He only knows the Hunger, and is responding to it.

It depends on intent. Is he taking down a bank manager that's standing in the way of financing for his new Victorian house? Probably murder. Is it a random killing because he's hungry and needs sustenance, making sure not to take a mother or caretaker or something? Then, more likely predation.

The answer is (a) legally murder. I did my research, looking at old newspaper clippings from Transylvania. During one year Dracula killed eight vampires. He was arrested, put on trial, and convicted on all eight Counts.

You have some very interesting potential clients. I would say it's murder. I would also recommend the advice from the wu tan clan which is: protect your neck.

I'd drop him. We can't even establish if he's a living human and therefore subject to the laws of the land. It sounds like a nightmare, and I'm NOT talking about his hellish god-forsaken powers.

Vampires never kill someone then suck their blood; it’s incompatible with the need to feed from a live host. If the host subsequently dies of organ failure, one needs to prove the feeding was a proximate and predictable cause of death before one could establish mens rea. In this paper we establish…

Pond rules* Natural predation, however, vampire hunters are also natural predation and are thus also not guilty of murder of the undead? The successful parasite does not kill or overly inconvenience the host or it gets reacted to is the main lesson here. (Capitalism take note) *Hoppers movie

Murder but in the way a non-vegan understands vegan ideals but still eats burgers. He doesn’t see Mina as a burger but he does see other people like random guys just trying to ship his coffin as basically vampire burgers. Like if Moby occasionally ate McDonalds.

I don't think it's a matter of natural predation or not; we prohibit many forms of natural predation. The question is whether (1) Dracula is subject to the jurisdiction of relevant court and (2) Dracula is defined as an entity whose conduct regulated by relevant law.

The first thing Dracula does in DRACULA is hire a solicitor to transfer his assets from the Austro-Hungarian Empire to the United Kingdom, he pretty clearly understands the legal system and operates within it.

he could probably say he has no choice. it's kill or starve for him. I guess there's no proof he has to kill someone to drink their blood, but he kind of has to at least assault people to survive.

Hmm… ok, if a person was specifically targeted for who they are, then probably murder. If no targeting, and it was just whomever was slowest, then probably natural predation. Seems fair 😆
