Today's Supreme Court decision does not opine on the constitutionality of Trump's assault on birthright citizenship. It is limited to the question of universal injunctions. But its ruling on that front is MASSIVE—a huge blow to plaintiffs and judges trying to block Trump's most lawless policies.

I want to reiterate that countless conservative judges issued universal injunctions against the Biden administration, and the Supreme Court never halted the practice. Now, barely five months into Trump's second term, the court puts an end to these injunctions. A brazen double standard.

Question:Executive actions can be overturned by the next POTUS, and Congress can pass laws that override EOs. Right? So it’s more important than ever that Dems capture BOTH houses of Congress in the midterms.

There is no double standard. There’s one standard. Republicans vote. Dems do occasionally when it’s exciting and convenient, if Love Island isn’t on that day. So, Republicans decide who gets to be judges and interpret the laws and they want judges who side with Republicans. That’s the standard.

Three of the current justices were nominated by a President who lost the popular vote and two by a President who had the benefit of the incumbency after previously losing the popular vote. Your blame misses the mark when it comes to SCOTUS.

If you say so. I remember Hillary saying 2016 was the most important election of our lifetimes. I believed her then. Still do. Seems like if enough Dems could be bothered to vote in that one, we’d be in a much different position now. Everything that’s followed are the consequences she told us about.

It’s not me “saying so.” That’s how it is. Five of the six in the conservative majority were nominated by a President who either lost the popular vote or did so because they had the benefits of the incumbency they earned after losing the popular vote.

Aren't they tying their own hands , I don't think it consolidates their power I think it lessens it, as it disrespects all judicial rulings and takes away power from the judiciary, takes away you just show power if it ever gets it to the court if it even gets that far?

Roberts’ Court has unleashed this lunatic on Democracy. But they are among the very rich who believe they will be untouched and hate liberals. Life time jobs for SCOTUS should be eliminated. This conservative Court has been hanging on for this perfect storm.

I look forward to this same exact court greenlighting the first nationwide injunction issued by a red state as soon as Dem's are in control of federal government again

This extremist Supreme Court is in FELON Trump's pocket. This extremist Supreme Court hates the U.S. Constitution & craves a king - even an unhinged lunatic FELON/criminal con man/sexual predator. So CORRUPT!

Like they care. They were always about gaining and keeping and wielding power. Rights for me but not for thee. Past time the Democrats learned to fight fire with fire. They COULD gum up the works as much as the Republicans did. But they will not do that. Their donors do not want it.

I really don't understand what they think they're doing. No ability of lower courts to issue universal injunctions against future President Pritzker or AOC? Ok, then I guess...

No dbl std-Biden was there for 4 yrs and he didnt do a thing knowing that the right wing was getting stronger. Bcos dems wanted all this to happen. That is why the gerontocracy and establishment among the dems need to be weeded out. As all of them are in cahoots with right wing republicans

So, correct me if I'm wrong, but does this mean every lower court can block an executive branch action - but only in their district? So then, there will be a massive patch work of different laws, of every kind, across the country? Asking this of multiple legal experts.

It is difficult to have any respect for the supreme court at this point. You don't need a law degree to see the laughable contortions the knot themselves into to assist with a right wing makeover of the country. Let alone the fact some of them have been taking bribes for decades.

But did anyone ask them to halt the practice during Biden administration? They can only rule on an “actual case or controversy” per the constitution.

yeah, but you gotta admit, some folks getting a little break from their student loan payments poses a dire threat to the republic. much more so than some masked brownshirts deporting us citizens to a foreign gulags does.

As Sotomayor very clearly points out, the implications of this ruling — which can only be understood as the purposeful withdrawal of judicial authority in reaction to the aggressive assaults of an authoritarian executive — are staggering.

The three "liberal" Justices (not the six fascists) are trapped in the SCOTUS : they cannot resign, and they are condemned to the eternal minority, watching at the dismantlement of the American Constitution and its replacement by the Trump Constitution

The biggest failure Democrats are certain to make is that upon returning to the White House, they will promise to "restore" our governing norms instead of leveraging the power SCOTUS hands to Trump, because the party foolishly believes a "return to normalcy" is possible. This IS the new normal.

It is up to The People to restore the rule of law and our Constitution. The Supreme Court has been corrupted and is no longer beholden to our Constitution, ethics, or integrity but to their own individual self-interest and financial enrichment. We, The People, need to restore our Constitution.

A functioning Senate Democrat leadership would easily be able to run on the illegitimacy of the Supreme Court by explaining to the public the implications of these rigged rulings. Instead, the plan is still, "maybe the stars will align in 2157, and we'll rollback one of these rulings per term."

I guess we won’t see any more buddy stories about the justices. On a serious note: it must be extremely difficult for the liberal justices to continue to function on this court. Any substantive evaluation seems to require them to abandon this charade and quit. Strategically however they need to stay

The complicit Republican Party is getting away with the shredding of the constitution. Trump is only a Republican Party tool. If the fault is not laid at the feet of the Republican Party, how do we make a significant necessary correction in the house and senate? One man does not do this alone.

I understand there is some debate about the scope of this ruling, but my view remains that the Supreme Court has just effectively abolished universal injunctions, at least as we know them. The question now is really whether lower courts can craft something to replace them that still sweeps widely.

Yes. Injunctions now only apply to the individual who took the case to court instead of the entire class of people harmed by the action blocked by the injunction. Each victim must have their own case. Add to that... the BBBill has a clause in it that makes it VERY expensive to sue for protection.

Could a state bring a claim & receive a statewide injunction? Or class action with several states opting in & allowing only the ruling to affect those states? Or class action that only applies to those individuals that choose to opt in? Creates massive variance potentially within a single state

What's funny is Kavanaugh's concurrence predicts exactly this, he has no idea how the system will function after this decision, but he's completely fine with it anyway

Trump's Justice Department is about to file a motion in every lower court where it faces a universal injunction citing this case and arguing that the injunction must be narrowed. This will have huge downstream consequences for a ton of other extraordinarily important and controversial cases.

Possible weird question, but, when there's a democrat in the White House again, is there a potential path for someone to bring a case to reinstate the ability? Or legislation that could be passed?

Supreme Court limits nationwide orders that have blocked Trump’s birthright citizenship ban The only recourse is to increase monthly donations to ACLU 10-fold. Do it now or hold your complicit conscience in shame for millions of innocent lives to endure exile, suffering, incarceration, and genocide

as absurd as it sounds since there's ltrl legal reason for delineating federal rights by court district, I feel like reissuing the injunctions to only cover those within the district court's remit would be an appropriately "non-universal" response to this asinine ruling.

But on the flip side it means they are about to be faced with having to respond to thousands more cases that will be filed to challenge any one law, regulation, or EO.

Will this lead to a big increase in court cases throughout the country as people seek the same relief in each circuit court? If so, not only do resources get wasted but it helps Trump’s common strategy of delays when it suits him.

Supporters of this decision will say: just seek class certification. But (1) the court has spent decades making certification harder and (2) this will give judges and justices a technical tool--declining class cert--to block cases that they want to kill, but don't want to be seen killing.

And Dems will do a strongly worded letter and not a damn thing. They didn’t run on or try to do anything about citizens unities. Now this.

A Council of Nine, unelected Black Robed, (self proclaimed) Shamans who pretend to conjure up what long dead slave owners would have thought about current legal conundrums. A ridiculous way to legislate!

I remember airplane passengers across the country ripping off their face masks mid-flight after a Trump judge issued a nationwide injunction striking down the Biden administration’s mask mandate. Didn’t see many Republicans decrying that as an abuse of judicial power.
