Speak out. Call Congress and let them know this is on them. Allowing corruption to become deeper, more ENTRENCHED is NOT ACCEPTABLE. Fight for rule of law by supporting an independent press, ACLU, Democracy Forward. Support all those who fight for an end to this lawlessness. Push back matters. ACT

Underlying logic: Congress’s constitutionally assigned authority to enact laws that the executive branch must obey is itself unconstitutional because, well, the president can do whatever he damn well pleases, including keeping state papers as private property

Let’s face it. Trump leaves regardless of a Democrat taking the Oval and will take whatever he wants, shred whatever he wants, and that will likely filter down certainly to the cabinet secretary level. And I doubt sincerely after the burn with Judge Cannon etc. that we’ll do anything about it.

What a surprise ... NOT! Wanna bet the Supreme Court will have a different view of it? This indicates to me that Donnie is worried that if he survives his presidency, the indictments related to the Mar-a-Lago secure documents 'dump' will be revived and taken to prosecution.

Aren’t records OWNED by the American people, just like the White House? The only jurisdiction should be related to secrecy based on national security.

And I have formed my own justice department and we have concluded that the laws that say I’m not allowed to walk into a bank and take all the money are unconstitutional

Perhaps the next administration won’t dilly dally around for a year before doing anything. So this theory could be tested sooner rather than later. Assuming the case and the subject both survive that long, of course.

If Democrats ever gain control again they’d better make laws that hold this behavior accountable. Otherwise this will serve as the blueprint to finish off democracy. Oh, and FUCK TRUMP.

Don't think that's going to fly. It's not their decision, really. But this regime is lawless and thinks this will be enough of an excuse to cover up all the rest of the crimes they have committed.

Well it just naturally follows from "Every official act is immune from prosecution and investigation," as well as the important corollary, "Everything the President does can be construed as an official act." That second bit hasn't been tested yet, but do you really think SCOTUS would disagree?

Somehow i don’t think future DoJ’s are going to feel bound by previous DoJ conclusions in future. And that quite probably will include (by necessity) revisiting those that were long established pre-Trump.

Since the Presidential Records Act is by its nature enforced by the incoming administration, the opinion of Trump's people on this and many other matters is going to be irrelevant. If Trump steals documents again, there won't be any delays or deferential treatment.

I am certain they will leave more than enough to hang each and every one of the bastards except the one who gets to plead not guilty by reason of insanity. I'm not sure we need a record of even more criminality and treason. Its not like we are going to want to continue anything Trump did.

In his first term, he literally fired the guy whose job it was to collect and file Trump's trail of evide...paper records. Early on. The guy's staff was piecing together documents with scotch tape. There's gonna be nothing to put in that library except Trump merch and whatever he stole.

What sr white house official? Why are they given anonymity for this announcement? This administration's Presidential records are family & friends communication. Kushner & Witkoff negotiating family deals & the insider trading tips First step in new elections needs to take on corruption

Remember the Yoo/Bybee memos and the logic that they couldn't be held responsible for the contents because they were told to make the best arguments for legality not asked if it was legal or not and nobody else could because they had the memos saying it was legal and were following that guidance?

Oh. Well then, I'm glad the enforcement branch is the judge on this and not that we have an entirely different branch of government to adjudicate on this. If only there were a name for that process...?

This can't possibly stand. I can declare myself the queen of the world, but that doesn't make it true. Presidential Records Act of 1978 (PRA), codified at 44 U.S.C. §§ 2201–2209, mandates that all presidential records created or received after January 20, 1981, are the property of the

the United States and must be turned over to the National Archives and Records Administration (NARA) upon a President’s departure from office. Are we really going to let him do this again?

I know that's undoubtedly true. There's no one right now who can really hold him accountable. A majority party that doesn't care that he's most likely a pedophile isn't going to care about him stealing more of our secrets for his benefit.

Trump overhauled NARA as soon as he was inaugurated. He replaced the archivist and the Inspector General among others. He put Rubio in charge to oversee all that.

Yes, he did. That still doesn't change what the law requires. And, yes I'm well aware that they don't care what the law says but that doesn't stop the law from existing.
