Sony says "reasonable consumers" know they don’t own the digital PlayStation games they buy. It argues that it's "not plausible" to suggest that when they buy a digital game they actually believe they're "obtaining ownership" of it. www.videogameschronicle.com/news/sony-sa...

Because then no one would pay. They tried this a while ago, when games would come out mainly in physical, you could rent a game and play for a month. That seems to have evolved on what they call licences today, you "own" the licence until they say no.

They market it as ownership, and downgrade it to "you get to play this until we unilaterally decide otherwise - no promises on lifetime or warning" in the small print It's deceptive, it's anti-consumer, and it deserves all the backlash it's getting and more

If they wanted to do timed licences instead of ownership, they could just market it that way They don't An expensive access license for an unknown length of time just isn't appealing If WoW sold "access passes" that randomly gave X weeks of access, I don't reckon that would be popular either

Exactly. I don't like conflating this with criticism of the model itself. Some people are fine renting, subscribing, whatever. But it's not clear! It's intentionally not clear.

WoW do give you limited time access passes. It's called a yearly subscription. But you know about it. You know how long it lasts. The clue is in the title. This, what SONY are doing, is false advertising. When you BUY, you BUY. Period.

Indeed! I wouldn't buy a bottle of mints that randomly contains between 1 and 200 mints, is priced for 200, and always has a full bottle in ads - why would I do that for a game! Buying access for a specific amount of time? Each customer gets to pick whether that's worth it

Or they could sell such licenses at a price point "reasonable consumers" would be willing to pay. There's no way Sony should be able to get away with offering less than ownership while charging more than ownership without losing customers, if gamers are truly reasonable consumers.

Exactly. They unilaterally revoked access to my spouse's account after the account email got hacked and then refused to reset access or refund the recently renewed PS plus membership. In one moment they denied us access to a decade's (or more?) worth of purchases and any way to fix it. Disgusting.

And they will collude with every other gaming platform, they will all do it, and we all get to pay more for less ... with no guarantee of service. Can't for the life of me work out why we're in a cost of living crisis.

This all started with DVDs in that you weren't "buying" the media, you were buying a "license" to play it. But most jurisdictions allow you to make reasonable copies for personal use so you'd think that undercuts Sony's argument?

Sony be like: “You think when you BUY something with MONEY you OWN it? That’s insane!” I’d like to see one of these fucktards buy a yacht or a Lamborghini and be told they don’t actually own it.

It’s “reasonable” to believe that purchasing a game digitally would be like purchasing it physically, something that consumers have been doing with playstation’s game library since 1994

Sony is GRASPING at any straw they can. If i paid just as much for the digital as I did the physical then guess what, I own it. And if it costs slightly less then I'm considering that small discount the difference in cost of having to burn the disc.

not how it works in a legal sense unfortunately the legal precedent for this varies by country of course but especially in the states, Sony is fully in the right, and it's at best murky in most other places. Stop Killing Games has been fighting this battle for years now, it's a rough one.

So why I have I got a loft full of Sony PlayStation DVD games that I thought belong to my sons? Does this mean Sony owe me a small fortune in fees for storing games they say belong to them?

Put this to my adult children. Their response: “Reasonable gamers want pseudo game ownership to eat shit and d!e.” IOW, they are aware of Sony’s position and strongly disagree with that concept.

I suppose I am the only reasonable consumer seeing as how I read the TOS. You don't want reasonable electronics consumers sony, I avoid giving money to corporations whenever possible.

ok. not a lawyer here, but: pull posts across the internet of people saying they "own" a game. view post's surrounding context to determine if they reveal that game is digital or physical. if there's no adequate context, remove from sample. look at answer ratio for colloquial understanding of "own."

You do not own your games on steam, you own a revokable subscription to play those games. The ownership apocalypse already happened in PC in the early 00s. This is one of the many reasons why piracy is vital in preserving games, and why I strive to purchase DRM-free versions whenever possible.

Several games I have are no longer allowed for sale because of licensing issues. I'm still able to download and play them with no issues because Valve isn't stupid enough to kill its golden goose

steam also has this stupid “license, not ownership“ crap in their fine print despite other parts of their website literally saying “you own this game”. steam is just as evil don’t give them any points

"Last week Sony emailed players who had PlayStation accounts, reminding them that when they signed up the Terms of Service they agreed that “when you purchase or download a digital product from the PlayStation Store, you buy a personal licence to use digital products for private use”." 🤔😏😳 WHY??

dude why are companies trying to argue with their consumers now? wtf, is this what happens when you replace your pr department with ai? like i promise you guys that whining at consumers about how they're stupid and dumb for not buying your shit will not convince them to buy your shit lmao

I don't wanna be a reasonable consumer then. In fact I wanna be very unreasonable 🐈‍⬛ I am about to obtain ownership of anything I want the old true and tested way of our ancestors: the High Seas Way ☠️⛵️

It is absolutely plausible, because when consumers think about "ownership" of a media item, it is not the technical kind of "ownership" (control over IP) that they are referring to. They are playing with words. I suppose that's to be expected.

Some lawyers have 'interesting' definitions of the words "reasonable" and "plausible". Capitalists are becoming desperate to generate new or continuing profits. Ownership makes them less profits than the economic feudalism of licensing or subscriptions. There is ZERO reason to not OWN a game.

These fucking guys...no reasonable executive should think since we buy the game we think we own the IP itself.. no we just wanna be own the interactive software you happened to take our money for..

This will be the party line for digital media. All of it, from every company. Bypassing the cause celebre of subscription models, if we don't own it at $20-$50, *&* it's not rented... *WHAT IS IT?* In the end, I don't care. Vinyl and Physical Media bypasses this (minus remasters cutting scenes).

I get why people are upset because they're trying not to sell physical copies and people should have that option, but it the same thing when you buy a digital copy of a movie. Especially if it's stored in a cloud they can take that access away.

Sony is acting as if Xbox didn't shoot themselves in the foot with the disastrous xbone launch, costing them a lot during that generation, they are doing the same caliber of bullshit, well, I am very comfortable not getting the ps6, I'm just gonna take care of my Ps5, and focus on my pc.

This is exactly why people, including myself, have gotten back into purchasing physical media in a serious way (Games, DVD's, CD's, etc.). Not only do I not want to pay a subscription service for the rest of my life, I want to know for sure I own what I purchase. Sony's rug pull was sadly expected!

They're coming for your cars now too, with a lot of regular features starting to require subscription fees, including deactivating your EV battery if you don't pay. It won't be long before basic household appliances are effected by this cancer on society.

They know they're lying, that if tomorrow everyone went to buy a game and the button said "buy license" instead of "buy", that huge chunk of uninformed users would be concerned and start looking up what that means. That's why the button says "buy" and not "buy license" and they know it

Jokes on them, we're reasonable customers, a difference with an important distinction. Shame they've forgotten the beneficial relationship we used to have.. or the consequences of failing to deliver a product we want to buy. *Cough* 1983 *cough*

Actually, no. The average consumer *doesn't* know that the fine print even for physical releases of things like video games say they don't legally own them, due to long-standing trade laws.

Hence why they're so understandably angry when shit like this gets stirred up, which leads to them learning this fact, which leads to at least a good number of them wanting to do something about it.

Companies like Sony deciding to start testing the quiet part out loud by admitting it and taking away easy physical backups is not "reasonable". Saying "reasonable consumers already know this" is either an extremely oblique snipe at people who know, or borderline gaslighting of the masses.

I will fully admit that I enjoy digital games for their sheer convenience, and own numerous these days, but didn't fault anybody for preferring physical even before stuff like this started to turn south.

I’m yet to buy a ps5, but I already know it’ll be the last console I ever do when I finally get round to it the concept of a home arcade is something from the y2k era, it’s just outdated to restrict yourself so much when the internet exists and basically everyone has multiple PCs at home

I know it's a legal argument and not a debate, but why does "No reasonable customer" sound like such a direct ripoff of "No true Scotsman." Either many of your customers are "not reasonable" or you yourself did a poor job of explaining to your customers what you find reasonable.

Sony would be correct. You only own a license to use it as long as it is available. It’s up to the consumer to decide if they want to agree to those terms. I’m sure it’s all in the fine print that nobody reads.

Oh yes, information, you know, that thing so fundemental to the universe it can't really be truly destroyed, not even by black holes, but sure, objectively real to the point of being an indistructible component of the universe, but not real enough apparently to own when clicking buy

I think a reasonable consumer should understand this absolutely can and with increasing regularity will happen. Digital ownership that depends on some form of online infrastructure simply isn't, under capitalism.

That's a pretty general definition, but it could vary depending on legislation. So while a country would follow that, and thus free or private copies are legal, another might define piracy as any kind of unauthorised copy regardless of price or privacy

Yeah, those who know don't know it because "yeah of course (true understanding)", they know it because "yeah, of course 🙄 (corporate greed fucks us all and they have the power and money to do whatever they want anyway, who am i, little peasant, compared to their might to say otherwise)".

I'm a reasonable consumer and digital games were sold to me as equivalent to physical games. It is reasonable to assume that I was acquiring property when making a purchase with a single payment and no end of service date.

I have had zero reason to touch a 9th-gen console and that will also apply to the 10th. They have had nothing to offer, only things to lose, and only survive off the expectation the average consumer will buy the next new thing.

🇨🇦🙄That’s absolute bullsh•t! Sony saying you don’t own a video game when it clearly stated that to PURCHASE the game was at one price and to rent it? Were you were ever given the choice to rent it or not? Simply bullsh*t. I always flat-out purchased physical copies bc I didn’t trust them.

If you wanna get into retro games and don't want to deal with the BS of Sony, Microsoft, or Nintendo, I highly recommend getting an Anbernic. Consoles ranging from a minimum of $30 to $130 that can play up to PS2 on some models. AYN Thor can play up to Switch for $350 You own the games too.

Yeah, ive known for a while that you dont own digital "purchases" unless you can download it & add it to an extra hard drive. Which is why I dont buy from places like Sony anymore

Valve established this mindset already. We shouldn't be surprised that Sony and others are eventually following suit. People were vocal about this back when you had to install Steam to play HL2. Such is life.

If NOTHING else, and this would be the most insignificant possible victory, that should be a textbook case of false advertising. It's like advertising a house for sale, going through all the motions, and then revealing in teeny tiny fine print that it's actually a rental and you don't own squat.

I've never been a fan of digital purchases because I've always known that your ownership of those game licenses is even flimsier than physical media. We've never had full control over the media we acquire but at least with physical media you are free to sell that copy to others.

"You buy the right to play the game, until we decide otherwise". I'm sure these guys use to be carnival barkers, where you bought a ticket for one ride, not ownership of the attraction. Next up: "We limit the times you can play the game"

Starting in 2027*, a silent update, nonconsensually pushed by Google, will block every Android app whose developer hasn't registered with Google, signed their contract, paid up, and handed over government ID. Not just on phones, on Firesticks, any device that uses Android. keepandroidopen.org

And this is why I bought a cd, dvd and record player last month after being an early adopter to streaming in early ‘00 Now I am pissed I don’t have all those ‘00s indie records physically I associate with my youth but I got my parents records from theirs My sons switch games to be physical now

We say "reasonable platforms" know they just can’t bully gamers and force them off physical media overnight We argue that Sony can’t say it’s not plausible to provide physical or digital rights to “own, transfer, or sell” digital games when XBOX IS ALREADY DOING IT from physical discs of all things

What gets me the most is that they don't refer to you as a customer, you're a "consumer". You're simply a metric in their eyes instead of a person they're serving. Fucking horrible
