OpenAI has absolutely zero ideas. They have no business. This is not a real business line and it’s so utterly vague and specious, I’m shocked at the credulousness to just print it without saying “there is no logical way this works of course” or talking about how the CFO of OpenAI is saying nonsense

The technologies that are useful for drug discovery have very detailed, thoroughly negotiated terms for how and when royalties can be owed. And it has to be really, really valuable for a company to agree to them. You don't just show up and be like, oh yeah, our computers do things. Drug money here!

Oh for fuck’s sake I literally just did this same stupid waving the hands around like I can stop reality, earlier, about how totally unprepared I am to move cross country in two weeks, it didn’t do shit but it calmed my mental health briefly.

Investors love to find out that, not only is there a cloud over title/enforceability of their PortCos' IP, but also there's functionally a permanent royalty obligation on anything their PortCos monetize

The fun part is that literally every drug company will look at that idea and say "nope" and not use the AI. Like imagine if DeWalt said "hey here's a circular saw, only thing is you have to give us 5% of the invoice for every job you use it on." They would be bankrupt by the end of the year.

As a startup/midrange tech business lawyer, my favorite clients are those that have no business model but have spent all of their investors' money building their solution. This tells me volumes about the founders and the investors, but mostly about the investors, who are obviously as dumb as rocks.

venture capital is just like meth in that no sentence you ever speak will be understandable by another human being. the difference is your tweaker clothes are black turtlenecks and little kpop microphones

We’re just riffing man. We’re currently trying to convince investors we’re worth $830bn but you know we’re still in the ideation stage

Let’s get this clear for me - they rely on the IP of others which Open AI accesses almost entirely without payment but want to share in the revenue of IP paying customers develop? Ok, so now we know for sure they really have nothing.

That’s batshit insane. Like, imagine Autodesk saying to customers “we want a portion of any profits you make using AutoCAD”. They’d be laughed out of the business. OpenAI is delusional.

The idea of ChatGPT (or any LLM) having any practical use in drug discovery, let alone producing something worthy of a royalty is utterly laughable. I do antibody discovery for a living. There are machine learning models that are useful for structure prediction. LLMs don't do anything of value here.

To be fair, she didn't say the LLM had to help you with the discovery. For all they care, you use it to write your emails, but as soon as you make a discovery they want a piece of that pie. 😄

Yeah no LLM can do such a thing. A small machine learning model customized strictly around modelling molecules/peptide could be so used & are being used at a fraction of the cost of operating a LLM. Smaller single purpose built models are where real money in AI be for the foreseeable future.

This should make companies shy away from anything coming from OpenAI. Fantasies of grabbing a piece of whatever your company makes just because an employee used ChatGPT should be a huge red flag. I think there is a real fantasy of injecting themselves everywhere, infecting everything like a virus.

Reminds me of a previous CEO my company had. Obsessed with Amazon. Particularly and specifically jealous that they had, in his mind, "no brick and mortar" Trying to get rid of our "brick and mortar" was his white whale. We make trucks. We MANUFACTURE COMMERCIAL VEHICLES. Business brain. Yikes.

Literally anything ChatGPT would be doing is only possible because of the harvested work they stole and didn't compensate anyone for, so frankly I think it should be legal to shoot someone into the sun for being this arrogant but also completely oblivious to their hypocrisy.

I've seen commercials that this is the best time to be a problem-solver, so everyone needs to call dibs on a problem asap (and of course be willing to cut AI in on the profits) before all the problems are solved.

This. I’d expect to see EVERYONE paid out for all the data they scraped to produce the models. Which is lowly everyone on the planet who has published to the public internet. Not sure if they want those lawsuits.

Not trying to legitimize this idea, but there is a precedent for companies with very expensive products allowing start ups to use those products for almost nothing against a percentage of that startup’s future value. OpenAI’s problem is that they would likely still lose on those bets.

[making shit up as the words leave my mouth] Let’s say drug discovery [chatgpt does not do this] if we licensed our technology [chatgpt? GPT? You already sell api access what are you talking about] and you have a breakthrough [what?] and we get a licensed portion of sales [??? So you get…IP?]

having done academic research related to drug discovery.....have they ever talked to a computational biologist?? or anyone knowledgable about the (extremely lengthy and resource-intensive) process of bringing a drug to market??? the hubris here to use this specific example makes me so mad.

With that logic, Clippy should be named as an inventor for every time he popped up to say “it looks like you’re trying to draft a letter” in a patent document.

Isn’t this woman paid like a lot of money to come up with revenue streams? Like isn’t this her whole job figuring out how to handle money and this is the best she can do? I don’t even have a masters degree and I could handle money better than this.Fucking put me in the company coach.

Exactly. This is the precedent set with modern IP contract clauses. Say I work for a company and, in my off time, fiddle with things that might have an application somewhat relevant to what the company does. If I make it big, the company takes partial or full ownership of what I developed.

People already assert ownership over their ‘very special prompts’ as if those are somehow IP - the chances someone makes a discovery, LLM aided, then goes ‘yeah it was ChatGPT really’ are zero.

Ignoring the complete lack of understanding she has of drug timelines etc, their own terms of service says that the user "owns" the output of the model! Are they going to completely reverse that aspect of their business? (I'd love to see them try and see their userbase evaporate)

“Well you see, someone on your companies paid ChatGPT plan used our service to brainstorm drug names and our records indicate ‘Veridone’ was one of them and so we’ll take our cut now, thank you very much!”

So...can industrial robot manufacturers start collecting a portion of the money collected in the sale of every shitty Cybertruck that leaves the Tesla factory? Asking for several hundred manufacturers of tools used to aid/replace humans, the means of production...

So let’s say our product does something different than what it does. And once it does that thing, companies will not only pay us for it, they will pay us with % of future revenue from their products.

"we can't make enough money just violating everyone else's IP rights. we need to assert IP rights of our own on the stuff everyone else makes."

Even if they implemented some version of this idea - say, updating their ToS to require people to pay royalties for any "breakthroughs" enabled by ChatGPT - it would just chase off businesses who aren't interested in paying royalties in perpetuity to the Plagiarism Machine.

Top computer scientists have literally been saying this for years. “Ai” ie LLMs do not think. They are mechanisms for repeating shit in a database.

I am in no way defending Open AI when I say they are directly partnered with Eli Lilly, Sanofi to discover new drugs. But the path to significant profit is at least 5-7 years, and that assumes an early exit on a promising drug -- which Eli Lilly wouldn't sell off in the manner of an emerging pharma.

They're getting more and more desperate as they run out of investor cash to sacrifice to the slop machine, and it's now obvious to all but the most brain dead that the square peg isn't going into the round hole no matter how hard they push. [pops popcorn]

Wouldn't it be great if you never had to pay workers, And you were more productive? For Just 19.95 million a year, Our Mechanical Turk, will work as hard as a man in a cabinet pretending to be a Turk! Call Now and we'll throw in FREE self driving, That's FREE!

Soooo...they take a share of other companies' products created using AI then....of course pay it forward to all the people who created the training set that made it all possible. Right? Right?

We’re at the stage where the Neato Thing is now going to drive all business everywhere, and investors start creating their entire business in the Neato Thing’s image once it makes shmilliions of money… Even AI users know this is one of the reliable indicators that a Bubble is about to pop.

oh man this reminds me I've forgotten to transfer a portion of my salary to my third grade teacher for teaching me math

This is like the final boss of pseudo-futuristic technobabble. Vague speculation about hypothetical profits in a potential future but with a big ol' helping of desperation. She might as well just straight up yell "no really guys, there *are* ways we can make all this money we burned back!"

It's really funny that we often have to argue that technofeudalism is not a very useful nor specific term, that medieval feudalism did not work like that wadda wadda and then OpenAI is out there just going "yeah we want to be the overlords extracting rent from everything you ever use or make".

Doesn't this mean that they're potentially putting themselves on the hook for legal responsibility for every other output of their machine

It has already been established that generative AI output per definition cannot be subject to intellectual property. They've already stolen the data that the machine would use to be able to work. But it does not work, so they're trying to float the idea that "should it work, THEN you owe us money".

This is like selling an extremely expensive washing machine that might or might not work under the premise that, should it clean and dry clothes properly at some point in the future, the users must then pay even more money. It is absolutely ridiculous.

By that reasoning, every business that makes a saving or increases profits by using chatGPT to automate processes also owes a portion of that profit to OpenAI, right?

Exactly. Where would it end.. the owners of any software you use in a business, even the phones you use in the business etc etc would claim a right to a slice of your profits..? What utter drivel!

This is a brilliant way to ensure that the legal department of every large company that might have been considering the use of AI to advise stepping the hell away from it ASAP to avoid the risk of such claims being made on future profits.

It feels like we are reaching peak “Underpants Gnomes business model” territory, and we are trying to figure out what phase 2 is, when phase 1 already doesn’t make sense. For Sarah’s plan to work it would have to be in the contract you signed. And trying to enforce it will shift the AI cost/benefit

This is just the thing from The Office where at a business seminar a guy's business idea is just "every time you make a transaction, my company makes .2 cents. Or like, every time you make a phone call I get .2 cents"

The Supreme Court case about the monkey taking a photo suggests this won’t work—IP cannot be assigned to non-human entities if they generated it, at least in the US

Kinda reminds me of that story where a landlord or landlord group (I think in Australia?) floated being entitled to a cut of anything invented or created by a tenant using their rental.

So by that logic does the ministry of transportation also require a cut of the IP that travels over the roads? I mean he went to a meeting in a car…also auto manufacturers, fuel makers, we can go on…

Well, if their product is only half as capable as they are pretending, they should ask chat gpt to come up with a solid business model and run it as is 😅🤷🏽

In fairness, I think Isomorphic Labs (read: Alphabet’s commercialisation vehicle for AlphaFold, etc.) have already put a similar business model in place with pharmaceutical companies.

The more reverse centaurs they make out of people, the less time people waste in unhealthy behaviours like, you know, thinking, or writing about AI bubble bursts/deflation!

interesting to see that a billion $ co is trying to run the same "useless promoter" scam I've seen in game dev basically somebody offering to "promote" your game - make ~5 low-reach social media posts or something equally useless - for a major percentage of all revenue from that game

however these scams usually require: - a very high volume of wannabes so that picking a mark would be a numbers game - an unpopular brand that doesn't attract too much attention - the victim not understanding what they're giving away or being desperate enough so that it doesn't matter to them

I believe openai can still make it work but it seems likely to reflect poorly on them and collapse very quickly once word gets out though if they only target huge companies, it can be a while until all the people involved get together, ascertain that they've been scammed and overcome denial & shame

Isn't this the fifth business model they've tried? First it was individuals will subscribe, opensource AI blew that out of the water. Then it was businesses will subscribe, Deepseek blew that up. Then it was a porn site, turns out people don't like corporations watching their kinks. 1/2

What kind of biotech investor would let their portcos take that deal? The percentage on profits from future drugs is like ... Already spoken for long before a researcher is picking which models to use for combing which data for patterns?

Many many startups will absolutely promise to pay OpenAI huge amounts of their nonexistent future income, creating an imaginary debt they might be able to borrow against! It's like, oh, I dunno, giving away mortgages to people who can't pay them.

The same business model Napster had and that ended by destroying everything musical that wasn’t corporate cock rock. The complete opposite of what Napster wanted…

openai really benefits from the conflation of the kinds of ai/ml used in actual research with llms/chatgpt. nobody is using chatgpt for drugs research
