Talked with PEGI and they do not see anything wrong Balatro being rated 18+, nor with EA sports FC (and similar games) having a 3+ rating Blaming EU laws, blaming storefronts, waiting for the future. Sitting on their hands I thought some good might come of this, this sucks

Yeah, sorry, but if Balatro is 18+ for it's "gambling" then anything with loot boxes or slot machine mechanics should also be 18+. Can you imagine Forza Horizon 5 rated 18+ for "gambling mechanics"? Wild.

That implies that balatro has any type of gambling in it when their only reasoning for giving it 18+ is because "poker is associated with gambling." Like, by that logic let's make drinking illegal because it's associated with DEIs.

It is the craziest thing for me that Nintendo was forced to remove the game corner from the old Pokemon games for the rating but there's a Pokemon MOBA with actual gambling mechanics that's totally allowed

Just thought about it. If balatro has poker terms and chips that "can translate into real life gambling" then sports games should also be ticked because it can translate into sports betting.

🦝this means you're free to add swear words and prostitutes to the game (disclaimer we haven't played balatro so no idea if it already has swear words and prostitutes)

Time to rename the hands to "1 card that's higher than the others" "2/3/4/5 similarly-numbered cards" "5 cards that have the same shapes on them" "5 cards in numerical order" "3 similarly-numbered cards and 2 more cards that are a different number but also similarly-numbered" Rolls off the tongue!

i feel like EU agencies are usually more on top of things like this so the fact they simply do not see the EA sports games as actual gambling is insane to me

The sort of shit you got hit with is why Pokemon games can't feature Casino themed mini-games anymore (plus probably holding back NSO releases of the classic GB-GBA games), affecting even the North American localizations (even though the ESRB aren't that tight about it). Thanks, PEGI...

EA don't need to spend any money. Various governments have never classed sticker packs, collectable/trading cards, capsule machines, blind boxes, loot boxes or similar things as gambling. This issue is decades old.

Did you think regulatory bodies existed to serve and/or protect people or their children? Why, no--silly human. Regulatory bodies exist to exploit people and make shareholders money This includes children

Did they spell it out for you, and actually say "card games are evil, because traditional gambling is done with cards, and we don't want children enjoying cards?" Or did they just stonewall you, without ever admitting that?

Hi there! First, congrats for the success of Balatro (just came back from DICE so congrats for the new awards as well!!). Second, I agree that this is not normal. I’m the founder of ethicalgames.org and maybe I can help fighting this fight. Can we chat?

They're wrong for doing this, but it won't hurt Balatro in the long run. The permanent impact on the indie community has already been realized. We're in a new paradigm. Thank you, localthunk.

make a EU version where the cards are like “Floo of Glades” and the hands are like “Flesh” and “Two of the same thing!”

I made this post with sass, but it truly annoys me to this day that NBA2K20 is allowed a 3+ rating when they openly immitate gambling. I hope laws are changed in the future to clamp down on this, though I don't know how much I expect that to end up being the case. bsky.app/profile/aval...

This should have been the gameplay for Balatro if @localthunk.bsky.social wanted a 3+ rating smh my head

Wait, so it's PEGI 18 while being unrestricted (Steam) and USK 12 (consoles) in Germany? "Blaming EU laws, blaming storefronts"… Yep… This actually feels worse than TES4 Oblivion (USK 12 vs. PEGI 16), which so far has been my go-to example on why German ratings aren't that restrictive anymore.

me several months ago when this first hit the news I see they're still terminally clueless

StormRider@stormrider.tv

long ago the great Roger Ebert reviewed Jackie Chan's "Legend of Drunken Master" and harshly criticized its R rating, saying its violence was more like kids' cartoons than brutal action films, finally stating "to rate this movie R is to be terminally clueless" anyway this post is about #Balatro

no, seriously, what the fuck are these people smoking this is some of the most bonkers moon logic I've seen outside of classic Sierra adventure games

I think this can be blamed on the fact that most europeans straight up just don't know what videogames are. We're talking about the place where public service and urban infrastructure simulators consistently rank among the best sold videogames.

Wow, this somehow makes it even more nuts It’s gambling because it is based around a fun card game that exists?? That generations of people can play and have played, with or without money? We better ban teaching probability in schools because it might make kids better at gambling!

the only things translatable from Balatro to real life poker are a) the hands and b) that both involve a standard 52-card French-suited deck of playing cards the logic here is like rating Yahtzee AO because dice and combinations thereof are also prevalent in casino craps

By this logic, Truck Simulator should be 18+ because you have to be 18 to get commercial drivers license. House Flipper should be 18+, because a bank isn't going to approve a mortgage for a kid. This is just absurd.

damn that sucks, is this the only form of appeal you can do? is it maybe possible to take to court? hope you succeed since imo both balatro is suited for kids and sports games (and IAP's in general) need to be regulated better desperately.

I wonder if this type of rating would have happened at all if the game was about Hanafuda, Mahjong or literally any other non-western "gambling" game. Not saying that the game would be better if it wasn't poker, but there's this weird prejudice with poker in which I want to find out why

EU gambling laws are legitimely so much harsher on fake gambling than real gambling it's insane. A very apt example is how you can't bet with twitch points in many EU countries but twitch can still run ads for online casinos.

First off, this sucks. Sorry you’re going through this. Could you rename the poker hands to animal terms (Full Barn, Line of Crops), replace chips with seeds, and change the face cards to farm animals? Would that change their minds? It could be a special PEGI version.

Kinda like the green blood in videogames back in the day. Just replace the poker suits with made up shapes or patterns or something and I bet it would pass.

It may or may not as there are games that already have the actual Poker cards in them that didn't also reach this level of scrutiny. There are also games with actual slot machine/gambling mechanics that didn't. This one's just an incredibly strange take all the way around.

Sonic Origins came out in 2022, has a rating of 3+ and has slot machines in it (in Casino Night Zone in Sonic 2 and in one of the Sonic 3 bonus stages). I doubt they'd dare to make a Sonic game 18+ however. PEGI is absolutely being inconsistent on purpose.

What if casinos started pulling up random twitch streams of people opening loot boxes and started taking bets on the pulls? Would that get organizations like PEGI to recognize them as gambling?

Is this a cultural thing? yesterday I had an argument where I said poker was just a game, that the act of gambling was an entirely different thing and detached from the card game, gambling can apply to any kind of game, but PEGI’s explanation makes me think there’s something against poker itself

@pbustinduy.bsky.social can we even see something about this? As much of a card game Balatro is, there's a difference between a singleplayer, no extra payment game and a microtransaction-filled one. And I doubt the PEGI ratings should go that way. NBA 2K had literal slots machines! A PEGI 3 game!

You'd think given the widespread success, prevalence, and acclaim Balatro has received that they'd be willing to work a little closer with you or at least provide further clarification instead of just doing straight nothing and letting this insanely high age rating impact sales

As a parent, this is such nonsense and goes to prove that I can't trust what's claimed. I need to pay attention and come to my own conclusions. I would 100% let her play Balatro over anything with actual loot crates, micro transactions, and predatory online stuff.

sucks, for real. you should make a "PEGI 3+ Approved" version that replaces all of the playing cards with monsters and the four suits with four colors, and then add actual mobile gambling and loot boxes. guarantee you get the 3+ rating day one.

What about their 75 3+ ratings for Mahjong, a gambling game where, supposedly, Chinese rulers in the 19th century considered it be indecent and corrupting, and they told historians not to document it to keep it from spreading?

What if you made a PEGI-safe edition that uses footballer instead of playing cards? Just pick 4 countries with enough famous footballers and then rank them. Have kids 3 and up make a straight flush that includes Pele, Ronaldo and Neymar. It's kinda dumb, but so is PEGI's ruling.

My guess is the raters weren't even aware of this mini game. From what I read of the BBFC Manhunt 2 scandal, publishers self declare the content of the game and prepare some video snippets for the raters to view. They don't have time to play everything in depth.

I heard once that the us was thinking about changing the law that would have made the ESRB have to play ALL content, including ALL user generated content before providing a game a rating and you couldn't release a game that was unrated and each new user generated content would cause a re-rate.

I believe this is the case. Specific situations deemed questionable by the publisher/developer are declared. If something in the game is spotted that wasn't noticed originally (EG: The Hot Coffee mod), then the age rating is jacked up, but that basically never happens.

This was rated Pegi 12 on release because of gambling, and if Nintendo were to release the game again it would be rated 18+, unless they take down the luigi poker minigame. Same with Pokemon and why the Pal release of pokemon platinum dorsn't have a slot machine in the game corner. It's so dumb

Load it up with the most aggressively expensive and disgusting microtransactions hidden behind visually stunning and attention grabbing buttons with no confirmation dialog before purchase. Run ended? Click here to keep going! (Just $99.99!)

As a parent, this just encourages me to overlook PEGI ratings. I knew CERO was xenophobic, but it’s not to this extent. All I want is a system that prioritizes children above all else.

the idea that a game with cards is inherently gambling because other people use cards to gamble is just absolute bonkers to me. now...if they said it earned the 18+ because of space joker and wheel of fortune then who am I to disagree. I'll bet the house on the pony for every wheel of fortune I see

I'm not sure how Nintendo keeps getting away with this, particularly when their game has straight-up poker and blackjack with wagering in it. I mean I could hazard a guess what the deal is, but I don't know for sure.

Real gambling is okay but digital gambling is bad. Look at what PEGI did to Pokemon's various game corners. The solution is to add "surprise mechanics" and real gambling to the European version of Balatro.

I once had a paper doll-style app to make comic hero characters. It got slapped with an 18+ rating by Apple because there were two gun equipment options. Still images, no interaction, no shooting. Millions of games where you actively shoot and kill people that aren't rated 18+, but they got us!
